The Secretary of State for Trade and Industry, with consent of the Treasury, in exercise of the powers conferred on him by section 56(1) and (2) of the Finance Act 1973(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Measuring Instruments (EEC Requirements) (Fees) (Amendment) Regulations 1997 and shall come into force on 1st April 1997.
2. The Measuring Instruments (EEC Requirements) (Fees) Regulations 1993(2) are hereby amended as follows—
(a)in paragraph 1(a) of Schedule 2, for “£58.00” substitute “£63.00”;
(b)in paragraph 1(a) of Schedule 3, for “£60.00” substitute “£63.00”, for “£58.00” substitute “£63.00” and for “£11.50” substitute “£15.00”;
(c)in paragraph 1(a) of Schedules 5 and 6, for “£60.00” substitute “£63.00” and for “£58.00” substitute “£63.00”;
(d)in paragraph 1(b) of Schedules 5 and 6, for “£11.50” substitute “£15.00” and for “£58.50” substitute “£60.00”.

These Regulations amend the fees payable in connection with services undertaken by the Department of Trade and Industry under the Non-automatic Weighing Instruments (EEC Requirements) Regulations 1992 (S.I. 1992/1579) and other Regulations relating to instruments for which the Measuring Instruments (EEC Requirements) (Fees) Regulations 1993 (S.I. 1993/798) (“the 1993 Regulations”), as amended, provide.
On the coming into force of these Regulations—
(1) the fees payable under regulations 3 and 4 of the 1993 Regulations in relation to which a rate per hour is specified in paragraph 1(a) of Schedules 2 and 3, are amended as follows—
(a)the rate for EEC initial verification of certain measuring instruments and systems becomes £63.00 per hour (an increase from £58.00 per hour), (regulation 2(a));
(b)the rate for EEC pattern approval becomes—
(i)for equipment test unit staff, £63.00 per hour (an increase from £58.00 per hour);
(ii)for examination staff, £63.00 per hour (an increase from £60.00 per hour); and
(iii)for any time during which the pattern is tested in an environmental testing chamber, £15.00 per hour (an increase from £11.50 per hour) (regulation 2(b));
(2) the fees payable under regulations 6 and 7 of the 1993 Regulations in relation to which a rate per hour is specified in paragraphs 1(a) and 1(b) of Schedules 5 and 6 (which relate to the grant of an EC type-approval certificate or for EC unit verification) become—
(a)for examination staff, £63.00 per hour (an increase from £60.00 per hour);
(b)for equipment test unit staff, £63.00 per hour (an increase from £58.00 per hour);
(c)for any time during which the type or instrument is tested in an environmental testing chamber, £15.00 per hour (an increase from £11.50 per hour); and
(d)for any time during which the type or instrument is tested for electromagnetic compatibility, £60.00 per hour (an increase from £58.50 per hour) (regulations 2(c) and (d)).
