SALMON AND FRESHWATER FISHERIES

The River Stinchar Salmon Fishery District (Baits and Lures) Regulations 1996

The Secretary of State, on application to him by the River Stinchar District Salmon Fishery Board, having consulted and directed that notice be given in accordance with paragraphs 3 and 4 of Schedule 1 to the Salmon Act 1986(1) as applied by section 8(5) of that Act, and there being no representations or objections made to the application, in exercise of the powers conferred on him by section 8 of that Act and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the River Stinchar Salmon Fishery District (Baits and Lures) Regulations 1996 and shall come into force on 1st January 1997.

Specification of baits and lures and area of application

2.—(1) Natural prawns and shrimps (whether fresh or preserved, dyed or natural colour) and any part thereof are hereby specified as baits and lures for the purposes of the definition of “rod and line” in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951(2).

(2) These Regulations shall apply to the River Stinchar Salmon Fishery District.

Explanatory Note

(This note is not part of the Regulations)

These Regulations specify natural prawns and shrimps, and any part of them, as baits and lures for the purposes of the definition of “rod and line” in section 24(1) of the Salmon and Freshwater Fisheries (Protection) (Scotland) Act 1951.

The Regulations apply to the River Stinchar Salmon Fishery District.

The effect of the Regulations is to prohibit the use of natural prawns and shrimps or any part of them as baits and lures when fishing by rod and line for salmon or sea trout.

1951 c. 26; the definition of “rod and line” in section 24(1) was amended by section 8(6) the Salmon Act 1986.
