Whereas a draft of this Order has, in accordance with section 13(5) of the Justices of the Peace Act 1979(1), been laid before and approved by resolution of each House of Parliament:
Now, therefore, Her Majesty, in the exercise of the powers conferred on Her by section 13(4) of the Justices of the Peace Act 1979, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
1.—(1) This Order may be cited as the Maximum Number of Stipendiary Magistrates Order 1996 and shall come into force on the day after the day on which it is made.
(2) In this Order—
(a)“stipendiary magistrate” means a stipendiary magistrate appointed under section 13 of the 1979 Act in any commission area or areas outside the inner London area and the City of London;
(b)“the 1979 Act” means the Justices of the Peace Act 1979.
2. The maximum number of stipendiary magistrates specified for the purposes of section 13(4) of the 1979 Act shall be fifty.

This Order in Council provides for the maximum number of stipendiary magistrates (other than metropolitan stipendiary magistrates) appointed under the Justices of the Peace Act 1979 to be raised from forty to fifty.
