19. —
(1) The Social Security (Incapacity Benefit—Increases for Dependants) Regulations 1994(1) shall be amended in accordance with the following provisions of this regulation.
(2) In regulation 10, in paragraph (2) for the words “the amount specified in paragraph 1 of Part I of Schedule 4 to the Contributions and Benefits Act” there shall be substituted, subject to paragraph (3), the words “the amoiunt for the time being specified in regulation 79(1)(c) of the Jobseeker’s Allowance Regulations 1996 (age related amount for a claimant who has attained the age of 25).”.
(3) Where the amount for the time being specified in regulation 79(1)(c) of the Jobseeker’s Allowance Regulations 1996(2) is less than the amount specified in paragraph 1 of Part I of Schedule 4 to the Benefits Act as in force on 6th October 1996 paragraph (2) above shall have effect as if the words substituted by that paragraph were “£48:25”.
(4) Paragraph (3) above shall applly in a particular case only for so long as the amount substituted by that paragraph is greater than the amount specified in regulation 79(1)(c) of the 1996 Regulations.
