10.—(1) Regulation 24 of the Maintenance Assessment Procedure Regulations shall be amended in accordance with the following provisions of this regulation.
(2) After paragraph (2) there shall be added the following paragraph–
“(3) Where–
(a)a child support officer refuses an application for a maintenance assessment on the grounds of lack of jurisdiction;
(b)the applicant makes no application at that stage for that refusal to be reviewed under section 18(1)(a) of the Act but applies to a court for a maintenance order in relation to the children concerned;
(c)the court refuses to make a maintenance order on the grounds of lack of jurisdiction; and
(d)the applicant then makes an application for the refusal mentioned in sub- paragraph (a) to be reviewed under section 18(1)(a) of the Act,
the date the applicant is notified of the court’s decision shall, for the purposes of paragraphs (1) and (2), be treated as the date of notification to the applicant of the decision whose review he seeks.”.
