The Haydon Natural Gas Pipe–lines Order 1993

The Secretary of State, on an application in that behalf being made to him by Associated Gas Supplies Limited, and in exercise of the powers conferred by section 7(2) of the Pipe– lines Act 1962(1) and now vested in him(2), hereby makes the following Order:

1.  This Order may be cited as the Haydon Natural Gas Pipe–lines Order 1993 and shall come into force on 19th October 1993.

2.  In this Order, the “Haydon area of Swindon” means land which is described in the Schedule hereto and which is delineated and shown shaded in green on the map annexed hereto.

3.  Section 7(1) of the Pipe–lines Act 1962(3) shall not apply to the construction of pipelines situate wholly within the Haydon area of Swindon, being pipe–lines for the conveyance of natural gas.

SCHEDULEDescripton of land comprised in the Order

Land550 hectares of land or thereabouts in the town of Swindon in the County of Wiltshire, lying to the South of Tadpole Lane and Lady Lane, to the West of the A419 Road and the Cricklade Road, to the North of Penhill and Haydon Wick, and to the East of the River Ray.

Explanatory Note

(This note is not part of the Order)

Under section 7(1) of the Pipe–lines Act 1962 the construction of a pipe–line of a length not exceeding ten miles which is to form an addition to another, is deemed to constitute the construction of a cross country pipeline (the construction of which would be unlawful unless authorised by the Secretary of State under section 1 of the Act), if the aggregate length of both exceeds ten miles. However, section 7(2) enables the Secretary of State to direct that section 7(1) shall not apply to the construction of pipe–lines of a specified class within a specified area. This Order provides that section 7(1) shall not apply to the construction of natural gas pipe–lines in a particular part of Swindon.
