The Minister of Agriculture, Fisheries and Food in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred by sections 1(2)(b), 2 and 3(1) and (4) of the Plant Health Act 1967(1) and now vested in them(2) and of all other powers enabling them in that behalf, hereby make the following Order:
1. This Order may be cited as the Plant Health (Great Britain) (Amendment) Order 1992, shall apply to Great Britain and shall come into force on 1 January 1993.
2.—(1) The Plant Health (Great Britain) Order 1987(3) shall be amended in accordance with the provisions of this article.
(2) In article 10 (General provisions relating to certificates) for paragraph (5) there shall be substituted the following paragraph–
“(5) Except in the case of consignments imported into Great Britain by post, any phytosanitary certificate and reforwarding phytosanitary certificate accompanying a consignment from any country which is not a Member State shall be delivered to the proper officer at the same time as, and together with, the entry relating to the consignment. In this paragraph the expression “proper officer” has the like meaning as in the Customs Act and the reference to the entry shall be construed as reference to the entry, delivery of which is to be made in accordance with the provision of that Act.”.

This Order amends the Plant Health (Great Britain) Order 1987 so as to modify the requirement for phytosanitary certificates to be presented to an officer of Customs and Excise upon the entry of plants and planting material into Great Britain.
1967 c. 8: sections 2(1) and 3(1) were amended by the European Communities Act 1972 (c. 68), section 4(1) and Schedule 4, paragraph 8; section 3(4) was substituted by section 42 of the Criminal Justice Act 1982 (c. 48).
