The Gloucestershire Districts (Electoral Arrangements) (Variation) Order 1991

The Secretary of State, in exercise of his powers under sections 69 and 266 of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, and after having complied with the procedures laid down in sections 69(2) and (3) of that Act, hereby makes the following Order, which varies supplementary provisions contained in the Gloucestershire Districts (Electoral Arrangements) Order 1991(2) an order made by him pursuant to his powers under sections 51(2) and 67(5) of the Act on 21st March 1991:

Citation and commencement

1.  This Order may be cited as the Gloucestershire Districts (Electoral Arrange-ments) (Variation) Order 1991, and shall come into force on 1st December 1991.

Electoral arrangements in Cheltenham

2.—(1) The Gloucestershire Districts (Electoral Arrangements) Order 1991 shall be varied as provided in paragraphs (2) and (3).

(2) There shall be substituted for article 3(8) of that Order—

(8) Subject to paragraph (9) below, of the councillors elected for the Leckhampton with Up Hatherley ward, for the Hatherley and The Reddings ward and for the Prestbury ward on the ordinary day of elections in 1991—

(a)the councillor of each ward elected by the smallest number of votes cast in that election for that ward shall retire in 1992;

(b)the councillor for each ward elected by the second smallest number of votes cast in the election for that ward shall retire in 1994; and

(c)the others shall retire in 1995..

(3) There shall be substituted for article 3(9)—

(9) If in relation to any of those wards an equality of votes between any persons elected makes it uncertain which of them is to retire in any such year, the councillor of the ward in question who is to retire in that year shall be determined by lot..

Explanatory Note

(This note is not part of the Order)

This Order varies supplementary provisions made in the Gloucestershire Districts (Electoral Arrangements) Order 1991 (S.I. 1991 No. 793). That Order created certain new wards of the borough of Cheltenham, including the Hatherley and The Reddings ward. The effect of the present Order is to vary provisions made in that Order for retirement of councillors so that a system for retirement by thirds applies in that ward.
