HOUSING, ENGLAND AND WALES HOUSING, SCOTLAND

The Housing Act 1974 (Commencement No. 4) Order 1975

12th March 1975

The Secretary of State, in exercise of the powers conferred upon him by section 131(3) of the Housing Act 1974 and of all other powers enabling him in that behalf, hereby makes the following order:—

1.—(1) This order may be cited as the Housing Act 1974 (Commencement No. 4) Order 1975.

(2) The Interpretation Act 1889 shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.

2.  The provisions of the Housing Act 1974 specified in the Schedule to this order shall come into operation on 1st April 1975.

SCHEDULE

Section 9 in so far as that section is not already in operation.

Section 34.

Section 105.

Section 119(1) in so far as it relates to the provisions of Schedule 11 specified below.

Section 130(1) in so far as it relates to paragraphs 5, 13 and 18 of Schedule 13.

Section 130(4) in so far as it relates to the repeals specified in the Table below.

In Schedule 11, paragraph 1(1), paragraph 1(3) in so far as it relates to the addition of paragraph (viii) at the end of section 24(3) of the Housing Subsidies Act 1967, paragraph 1(4) and paragraph 5.

In Schedule 13, paragraphs 5, 13 and 18.

Schedule 15 in so far as it relates to the repeals specified in the Table below.

EXPLANATORY NOTE

This Order brings into operation on 1st April 1975 the following provisions of the Housing Act 1974:—

Section 9(1)(a) and (b), (5) and (6) which relate to the powers of the Housing Corporation to make loans to registered housing associations and unregistered self-build societies.

Section 34 which relates to the transfer to the Housing Corporation of rights and obligations of the Secretary of State in relation to certain advances.

Section 105 which relates to the Secretary of State's control over certain expenditure by housing authorities in England and Wales.

Section 119 and Schedule 11 to the extent that they relate to the calculation of option mortgage subsidy on an interest accruing basis.

Paragraphs 5, 13 and 18 of Schedule 13 which relate to minor and consequential amendments to provisions of existing statutes in relation to housing associations and development corporations.

Schedule 15 in so far as it relates to the repeal of certain provisions of existing statutes concerning housing associations and development corporations.
