The Secretary State for Social Service in exercise of the powers conferred by section 3(2) of the National Health Service Act 1964 section 3(1) of the Health Service and Public Health Act 1968 and by section 57(1) of and paragraph 12(1) of Schedule 4 to the National Health Service Reorganisation Act 1973 and now vested in her(1), and of all other powers enabling her in that behalf, hereby makes makes the following regulations:—
1.—(1) These regulations may be cited as the National Health Service (Charges for Appliances) (Amendment) Regulations 1974, and shall come into operation on 1st April 1974.
(2) The rules for the construction of Acts of Parliament contained in the Interpretation Act 1889 shall apply for the purposes of the interpretation of these regulations as they apply for the purpose of the interpretation of an Act of Parliament.
2. In regulation 6(1) of the National Health Service (Charges for Appliances) Regulations 1974(2) after the “when it occurred, then” there shall be inserted—
“unless the person supplies is a person for whom medical inspection or treatment is provided under or by virtue of the provisions of section 3 of the National Health Service Reorganisation Act 1973 and in respect of whom evidence to that effect is produced to the Secretary of State or the Authority as the case may require ”

These Regulations amend the National Health Service (Charges for Appliances) Regulations 1974. they provide that pupils attending maintained schools or certain other educational establishment or being educated under special arrangements do not have to pay charges for the replacement or repair of appliances supplied to them by the Secretary of State or a Health Authority.
