The Treasury, in exercise of the powers conferred upon them by section 33 of the Superannuation Act 1965 and of all other powers enabling them in that behalf, hereby make the following Rules:—

1.—(1) Where a person was on the 1st April 1965 taken into the civil service of the State as an officer of the Ministry of Overseas Development after having been employed by a Tropical Research Unit, and his employment was, in the opinion of the Treasury, of the same nature and for the same purpose as his employment in the Tropical Research Unit, his service in the employment of the Tropical Research Unit before the 1st April 1965 may be reckoned for the purposes of the Superannuation Act 1965 as employment in an unestablished capacity within the meaning of section 99(1) of that Act.

(2) Where a person to whom the foregoing paragraph applies was, before the date on which he was taken into the service of the State, subject to a superannuation scheme operated under the Federated Superannuation System for Universities or the Agricultural Research Council Clerical and Technical Superannuation Scheme, it shall be a condition of the making of any payment under the Superannuation Act in respect of that person's service before that date, so far as that payment is dependent on the provisions of the foregoing paragraph, that there has been assigned, to such person and in such manner as the Treasury may direct, the policy of insurance purchased for that person under the superannuation scheme.

(3) These Rules shall not have effect so as to authorise an increase in an annual superannuation allowance or pension so far as the allowance or pension is payable in respect of a period before the coming into operation of these Rules.

2.—(1) In these Rules “a Tropical Research Unit” means any one of the following bodies: the Tropical Pesticides Headquarters and Information Unit; the Tropical Pesticides Research Unit; the Tropical Stored Products Centre.

(2) The Interpretation Act 1889 shall apply for the interpretation of these Rules as it applies for the interpretation of an Act of Parliament.

3.  These Rules may be cited as the Superannuation (Tropical Research Units-and Civil Service) Transfer Rules 1966, and shall come into operation on 5th July 1966.
