COAST PROTECTION

The Coast Protection (Variation of Excluded Waters) Regulations 1965

The Minister of Housing and Local Government, in exercise of his powers under paragraph 113 of Schedule 4 to the Coast Protection Act 1949, and of all other powers enabling him in that behalf, hereby makes the following regulation:—

1.—(1) These regulations may be cited as the Coast Protection (Variation of Excluded Waters) Regulations 1965, and shall come into operation on 16th February 1965.

(2) The Interpretation Act 1899 applies to the interpretation of these regulations as it applies to the interpretation of an Act of Parliament.

2.  Schedule 4 to the Coast Protection Act 1949 shall be varied as follows:—

For paragraph 21 there shall be substituted the following paragraph—

21.  The River Thames, above a line drawn from the westernmost point of Dagnum Saltings in the parish of Allhallows in the County of Kent, to Canvey Point, and thence to the westernmost point of the boundary of the County Borough of Southend, and the whole of the waters of Yantlet Creek..

EXPLANATORY NOTE

Schedule 4 to the Coast Protection Act 1949 excludes certain waters for the purposes of the definitions of “sea” and “seashore” in the Act, but provides that the Schedule may be varied either by adding waters to it or by removing waters from it. These Regulations by varying paragraph 21 of the Schedule (which relates to the River Thames) remove certain waters from it.
