Game Act 1831

  1. Introductory Text

  2. II.What shall be deemed Game.

  3. III.Days and Seasons during which Game shall not be killed.

  4. IV.Possession of Game illegal after Ten Days in Dealers, and Forty Days in other Persons, from the Expiration of the Season.

  5. VI.Every certificated Person may kill Game, subject lo the Law of Trespass. Proviso as to Gamekeepers.

  6. VII.Under existing Leases the Landlord shall have the Game, except, in certain Cases.

  7. VIII.This Act not to affect any-existing or future Agreements respecting Game, nor any Rights of Manor, Forest, Chase, or Warren.

  8. IX.This Act not to affect any of His Majesty's Forest Rights, &c.

  9. X.Nor to affect any Cattle-gates or Right of Common.

  10. XI.Landlord, having the Game, may authorize others to kill it.

  11. XII.Where the Landlord, &c. has the Right to the Game, in exclusion of the Occupier, the Occupier shall be liable to a Penalty for killing it.

  12. XIII.Lords of Manors may appoint Gamekeepers.

  13. XIV.Lords of Manors may grant Deputations.

  14. XV.Regulations respecting Appointment of Gamekeepers in Wales.

  15. XVI.All Appointments of Gamekeepers to be registered with the Clerk of the Peace.

  16. XVII.Certificated Persons may sell Game to licensed Dealers. Proviso as to Gamekeepers.

  17. XVIII.Justices to hold a Special Session yearly for granting Licences to Persons to deal in Game.

  18. XIX.Persons licensed to deal in Game must take out a Certificate, with a Duty of 2l.

  19. XX.Collectors to make out List of Persons who have obtained Licences to deal in Game.

  20. XXI.Proviso as to Partners.

  21. XXII.Licences when to become void.

  22. XXIII.Penalty for killing Game without a Certificate.

  23. XXIV.Penalty for destroying or taking the Eggs of Game, &c.

  24. XXV.Penalty for selling Game without Licence, and on certificated Persons selling to unlicensed Persons.

  25. XXVI.Exceptions as to Innkeepers.

  26. XXVII.Penalty on Persons buying; Game, except from licensed Dealers.

  27. XXVIII.Penalty on licensed Dealers buying Game from uncertificated Persons, or otherwise offending.

  28. XXIX.As to buying and selling Game by the Servants of a licensed Dealer.

  29. XXX.Penalty on Persons trespassing in the Day-time upon Lands in search of Game.

  30. XXXI.Trespassers in search of Game may be required to quit the Land, and to tell their Names and Abodes, and in case of Refusal may be arrested.

  31. XXXII.Penalty on Persons found armed using Violence, &c.

  32. XXXIII.Penalty for Trespass in Day-time in His Majesty's Forests.

  33. XXXIV.What to be deemed Daytime.

  34. XXXV.The Provisions as to Trespassers not to apply to Persons hunting, &c.

  35. XXXVI.Game may be taken from Trespassers not delivering up the same when demanded.

  36. XXXVII.Application of Penalties for Offences against this Act.

  37. XXXVIII.Time for Payment of Penalties, and Scale of Imprisonment for Non-payment.

  38. XXXIX.Form of Conviction.

  39. XL.Power to summon Witnesses.

  40. XLI.Time for Proceedings, and Mode of enforcing the Appearance of Offenders.

  41. XLII.Prosecutor not required to prove a Negative.

  42. XLIII.Convictions to be returned to Sessions.

  43. XLIV.Appeal.

  44. XLV.No Certiorari, &c.

  45. XLVI.This Act not to preclude Actions for Trespass, but no Double Proceedings for the same Trespass.

  46. XLVII.Venue, &c. in Proceedings against Persons acting under this Act.

  47. XLVIII.Act not to extend to Scotland or Ireland.
