Territorial Extent and Application

8.The Act extends to England and Wales and Scotland. Where the Act makes amendments to existing legislation, the amendments will have the same extent as that legislation. With regard to Wales, all matters contained within the Act are non-devolved.

9.The Scottish Parliament’s consent has been sought and obtained for the provisions in the Act that trigger the Sewel Convention (those in sections 1 to 3, which relate to the disbursal of funds under the CCS financial support mechanism). The Sewel Convention provides that Westminster will not normally legislate with regard to devolved matters in Scotland, or alter the executive competence of Scottish Ministers, without the consent of the Scottish Parliament.
