SCHEDULE 1British Coal Corporation: Consequential Amendments

The [1946 c. 59.] Coal Industry Nationalisation Act 1946

1(1)In section 1(1) and (2) of the Coal Industry Nationalisation Act 1946 for the words “National Coal Board” and “the Board” there shall be substituted respectively the words “British Coal Corporation” and “the Corporation”.

(2)In section 2(1) of that Act for the words “The Board” and “National Coal Board” there shall be substituted respectively the words “The Corporation” and “British Coal Corporation”.

(3)For the word “Board” wherever it occurs in sections 1(3) and (4), 2(2) to (8), 3, 4, 27, 28, 29(2), 30, 31, 36, 37, 38(2), 46 to 54 and 64(9) of and Schedule 2A to that Act and in section 38(3) in the second place where it occurs there shall be substituted the word “Corporation”.

(4)In sections 30, 37 and 46 of that Act for the word “Board's” wherever it occurs there shall be substituted the word “Corporation's”.

The [1949 c. 53.] Coal Industry Act 1949

2In section 1 of the Coal Industry Act 1949 for the word “Board” wherever it occurs there shall be substituted the word “Corporation”.

The [1952 c. 23.] Miners' Welfare Act 1952

3In the Miners' Welfare Act 1952—

(a)in sections 13 and 14 for the word “Board” wherever it occurs there shall be substituted the word “Corporation”; and

(b)in section 16 after the definition of “the Commission” there shall be inserted—

  • “the Corporation” means the British Coal Corporation.

The [1954 c. 56.] Landlord and Tenant Act 1954

4In the definition of “statutory undertakers” in section 69(1) of the Landlord and Tenant Act 1954 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1957 c. 59.] Coal-Mining (Subsidence) Act 1957

5In the Coal-Mining (Subsidence) Act 1957—

(a)in section 1(2) for the words “the National Coal Board (in this Act referred to as “the Board”)” there shall be substituted the words “the British Coal Corporation (in this Act referred to as “the Corporation”)”;

(b)in sections 1(3) to (5), 2 to 13, 15 and Schedules 1 and 2 for the word “Board” wherever it occurs there shall be substituted the word “Corporation”;

(c)in section 17(1) for the definition of “the Board” there shall be substituted—

  • “the Corporation” means the British Coal Corporation.

The [1958 c. 51.] Public Records Act 1958

6In Part II of the Table in paragraph 3 of Schedule 1 to the Public Records Act 1958 there shall be inserted at the appropriate place the words “British Coal Corporation”.

The [1958 c. 69.] Opencast Coal Act 1958

7In the Opencast Coal Act 1958—

(a)in section 3(1) for the word “Board” in the first place where it occurs there shall be substituted the words “British Coal Corporation (in this Act referred to as “the Corporation”)”;

(b)in section 14A(6) (a) for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”;

(c)for the word “Board” wherever else it occurs and the word “Board's” wherever it occurs there shall be substituted respectively the words “Corporation” and “Corporation's”; and

(d)in section 51(1) after the definition of “compulsory rights order” there shall be inserted—

  • “the Corporation” means the British Coal Corporation.

The [1962 c. 6.] Coal Industry Act 1962

8In section 2 of the Coal Industry Act 1962 for the words from the beginning to “the Board” there shall be substituted the words “The financial year of the British Coal Corporation”.

The [1964 c. 26.] Licensing Act 1964

9In section 56(3)(a) of the Licensing Act 1964 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1964 c. 29.] Continental Shelf Act 1964

10In section 1(2) of the Continental Shelf Act 1964 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1965 c. 82.] Coal Industry Act 1965

11(1)In section 1(1) of the Coal Industry Act 1965 for the words “the National Coal Board (hereafter in this Act referred to as “the Board”)” there shall be substituted the words “the British Coal Corporation (hereafter in this Act referred to as “the Corporation”)”.

(2)In sections 1(2) to (6), 2(3) and 4 for the word “Board”, wherever it occurs, there shall be substituted the word “Corporation” and in sections 1(4)(b) and 2(3) for the word “Board's” there shall be substituted the word “Corporation's”.

The [1966 c. 4.] Mines (Working Facilities and Support) Act 1966

12In paragraphs 3(1) and 4(2) of the Table in section 1 and in sections 4(5) and 9 of the Mines (Working Facilities and Support) Act 1966 for the words “National Coal Board” wherever they occur there shall be substituted the words “British Coal Corporation”.

The [1966 c. 27.] Building Control Act 1966

13In the Schedule to the Building Control Act 1966 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1966 c. 34.] Industrial Development Act 1966

14In Schedule 2 to the Industrial Development Act 1966 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1966 c. 47.] National Coal Board (Additional Powers) Act 1966

15(1)In section 1(1) of the National Coal Board (Additional Powers) Act 1966 for the words “National Coal Board (hereafter in this Act referred to as “the Board”)” there shall be substituted the words “British Coal Corporation (hereafter in this Act referred to as “the Corporation”)”.

(2)In section 1(1)(b) to (e) and (2) of that Act for the word “Board”, wherever it occurs, there shall be substituted the word “Corporation”.

The [1967 c. 91.] Coal Industry Act 1967

16In section 4 of the Coal Industry Act 1967—

(a)for the word “Board” where it first occurs there shall be substituted the words “British Coal Corporation”;

(b)for the word “Board” in the second and third place where it occurs and the word “Board's” there shall be substituted respectively the words “Corporation” and “Corporation's”.

The [1968 c. 65.] Gaming Act 1968

17In section 52(2)(a) of the Gaming Act 1968 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1971 c. 16.] Coal Industry Act 1971

18(1)In sections 4, 6, 7, 8 and 9 of the Coal Industry Act 1971 for the words “Board” and “Board's” wherever they occur there shall be substituted respectively the words “Corporation” and “Corporation's”.

(2)In section 10(3) of that Act for the definition of “the Board” there shall be substituted—

  • “the Corporation” means the British Coal Corporation.

The [1971 c. 78.] Town and Country Planning Act 1971

19In sections 192(1)(a), 216(2), 264(4)(b) and 273(1) and (2) of the Town and Country Planning Act 1971 for the words “National Coal Board” wherever they occur there shall be substituted the words “British Coal Corporation” and in section 273(1) of that Act for the words “the Board” and “that Board” there shall be substituted respectively the words “the Corporation” and “that Corporation”.

The [1972 c. 52.] Town and Country Planning (Scotland) Act 1972

20In sections 181(1)(a), 205(2), 251(3)(b) and 259(1) and (2) of the Town and Country Planning (Scotland) Act 1972 for the words “National Coal Board” wherever they occur there shall be substituted the words “British Coal Corporation” and in section 259(1) of that Act for the words “the Board” and “that Board” there shall be substituted respectively the words “the Corporation” and “that Corporation”.

The [1973 c. 8.] Coal Industry Act 1973

21(1)In sections 2(2) and 10 of the Coal Industry Act 1973 for the word “Board” there shall be substituted the words “British Coal Corporation”.

(2)In section 2(3) to (7) of that Act for the word “Board” there shall be substituted the word “Corporation”.

The [1974 c. 7.] Local Government Act 1974

22In paragraph 6 of Schedule 3 to the Local Government Act 1974 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1974 c. 40.] Control of Pollution Act 1974

23In section 25 of the Control of Pollution Act 1974 for the words “the National Coal Board” and the words “the Board” wherever they occur there shall be substituted respectively the words “the British Coal Corporation” and “the Corporation”.

The [1975 c. 24.] House of Commons Disqualification Act 1975

24In Part II of Schedule 1 to the House of Commons Disqualification Act 1975 there shall be inserted at the appropriate place the words “The British Coal Corporation”.

The [1975 c. 25.] Northern Ireland Assembly Disqualification Act 1975

25In Part II of Schedule 1 to the Northern Ireland Assembly Disqualification Act 1975 there shall be inserted at the appropriate place the words “The British Coal Corporation”.

The [1975 c. 30.] Local Government (Scotland) Act 1975

26In paragraph 6 of Schedule 1 to the Local Government (Scotland) Act 1975 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1975 c. 55.] Statutory Corporations (Financial Provisions) Act 1975

27In Schedule 2 to the Statutory Corporations (Financial Provisions) Act 1975 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1975 c. 56.] Coal Industry Act 1975

28(1)In section 1(1) of the Coal Industry Act 1975 for the words “National Coal Board (in this Act referred to as “the Board”)” there shall be substituted the words “British Coal Corporation (in this Act referred to as “the Corporation”)”.

(2)For the words “Board” and “Board's” wherever they occur in that Act (except in sections 1(4), 2(5), (6), (8), paragraphs 2(a) and 3(c) of Schedule 1 and in the first place they occur in section 3(8)) there shall be substituted the words “Corporation” and “Corporation's”.

The [1975 c. 70.] Welsh Development Agency Act 1975

29In paragraph (b) of the definition of “statutory undertakers” in section 27(1) of the Welsh Development Agency Act 1975 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1976 c. 1.] National Coal Board (Finance) Act 1976

30(1)In section 2 of the National Coal Board (Finance) Act 1976 for the words “Board” and “Board's” wherever they occur there shall be substituted respectively the words “Corporation” and “Corporation's”.

(2)In section 4(2) of that Act for the definition of “the Board” there shall be substituted—

  • “the Corporation” means the British Coal Corporation.

The [1976 c. 57.] Local Government (Miscellaneous Provisions) Act 1976

31In sections 15(3) and 26(6)(b) of the Local Government (Miscellaneous Provisions) Act 1976 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1976 c. 70.] Land Drainage Act 1976

32In section 112(2)(a) of the Land Drainage Act 1976 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1976 c. 75.] Development of Rural Wales Act 1976

33In paragraph (b) of the definition of “statutory undertakers” in section 34(1) of and in paragraph 8 of the Table in paragraph 56(3) of Schedule 3 to the Development of Rural Wales Act 1976 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1977 c. 39.] Coal Industry Act 1977

34(1)In sections 7, 9 and 10 of the Coal Industry Act 1977 for the word “Board”, wherever it occurs, there shall be substituted the word “Corporation”.

(2)In section 11 of that Act for the word “Board's” in subsection (1) and for the word “Board” wherever it occurs there shall be substituted respectively the words “Corporation's” and “Corporation”.

(3)In section 14(1) of that Act after the definition of “the Board” there shall be inserted—

  • “the Corporation” means the British Coal Corporation.

The [1979 c. 46.] Ancient Monuments and Archaeological Areas Act 1979

35In section 61(2)(b) of the Ancient Monuments and Archaeological Areas Act 1979 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1980 c. 50.] Coal Industry Act 1980

36In subsection (1) of section 2 of the Coal Industry Act 1980 for the word “Board” there shall be substituted the words “the British Coal Corporation” and in subsections (2) and (3) of that section for that word wherever it occurs there shall be substituted the word “Corporation”.

The [1980 c. 63.] Overseas Development and Co-operation Act 1980

37In sections 2(4) and (5) of and Part III of Schedule 1 to the Overseas Development and Co-operation Act 1980 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1980 c. 65.] Local Government, Planning and Land Act 1980

38In paragraph (b) of the definitions of “statutory undertakers” in sections 108(1), 120(3) and 170(1) of and in paragraph 14 of Schedule 16 to the Local Government, Planning and Land Act 1980 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1980 c. 66.] Highways Act 1980

39In section 290 of the Highways Act 1980, in subsections (5) and (7) for the words “National Coal Board” there shall be substituted the words “British Coal Corporation” and in subsection (5) for the words “that Board” there shall be substituted the words “that Corporation”.

The [1981 c. 67.] Acquisition of Land Act 1981

40In paragraph (a) of the definition of “statutory undertakers” in section 17(4) and in section 29(2)(b) and (c) of the Acquisition of Land Act 1981 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1982 c. 15.] Coal Industry Act 1982

41In section 3 of the Coal Industry Act 1982 for the words “Board” and “Board's” wherever they occur there shall be substituted respectively the words “Corporation” and “Corporation's” and in section 5 of that Act for the definition of “the Board” there shall be substituted—

  • “the Corporation” means the British Coal Corporation.

42In section 30 of the Iron and Steel Act 1982 for the words “National Coal Board” in both places where they occur there shall be substituted the words “British Coal Corporation”.

43In section 123(1) of the Civic Government (Scotland) Act 1982 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1983 c. 44.] National Audit Act 1983

44In Part I of Schedule 4 to the National Audit Act 1983 there shall be inserted at the appropriate place the words “The British Coal Corporation”.

The [1984 c. 50.] Housing Defects Act 1984

45In paragraph 1 of Schedule 4 to the Housing Defects Act 1984 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1984 c. 54.] Roads (Scotland) Act 1984

46In subsections (3)(b) and (4) of section 140 of the Roads (Scotland) Act 1984 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation” and in the said subsection (3)(b) for the word “Board's” there shall be substituted the word “Corporation's”.

The [1985 c. 68.] Housing Act 1985

47In section 573(1) of the Housing Act 1985 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1985 c. 72.] Weights and Measures Act 1985

48In paragraph 28(1) and (3) of Schedule 5 to the Weights and Measures Act 1985 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

The [1986 c. 5.] Agricultural Holdings Act 1986

49In paragraph 8(1)(a) of Part II of Schedule 3 to the Agricultural Holdings Act 1986 for the words “National Coal Board” there shall be substituted the words “British Coal Corporation”.

Section 3.

SCHEDULE 2Section 3 Grants: Eligible Expenditure

1Expenditure which is related to persons who leave the employment of the Corporation or of a wholly-owned subsidiary of the Corporation by virtue of redundancy or early retirement.

2Expenditure on payments made to or for the benefit of employees of the Corporation or of a wholly-owned subsidiary of the Corporation, or on the provision for them of housing or transport, by virtue of their work or place of employment being changed.

3Expenditure on the maintenance of existing social welfare activities (within the meaning of the [1952 c. 23.] Miners' Welfare Act 1952).

4Expenditure on the maintenance of existing arrangements for the provision of concessionary coal (that is to say, coal or other solid fuel supplied free of charge or at reduced prices) or other benefits to former employees of the Corporation or any wholly-owned subsidiary of the Corporation who have reached normal retirement age or their dependants.

5Expenditure on the provision of retraining for persons who are to leave or have left the employment of the Corporation or any wholly-owned subsidiary of the Corporation by virtue of redundancy or incapacity.

6Expenditure on the promotion of new employment in coal mining areas and of new employment for such persons as are mentioned in paragraph 5 above (whether in such areas or elsewhere).
