1E+WThis Schedule applies where interim protection ceases to have effect in relation to a monument as a result of the issue of a notice under section 1AB(4)(b) or (5)(b).

2E+WThe fact that the interim protection has ceased to have effect does not affect the liability of any person to be prosecuted and punished for an offence under section 2, 9ZG, 9ZK, 28 or 42 committed with respect to the monument while the interim protection had effect.

3E+WAny proceedings on or arising out of an application for scheduled monument consent with respect to the monument lapse, in so far as they relate to consent required by virtue of the interim protection; and any such consent granted lapses to the same extent.

4(1)Any scheduled monument enforcement notice served by the Welsh Ministers with respect to the monument ceases to have effect, in so far as the notice relates to works affecting anything in respect of which the interim protection had effect.E+W

(2)Any proceedings on or arising out of such a notice under section 9ZE or 9ZF(4) lapse, in so far as the notice relates to works affecting anything in respect of which the interim protection had effect.

(3)Notwithstanding sub-paragraph (1), section 9ZF(2) continues to have effect as respects any expenses incurred by a person authorised by the Welsh Ministers as mentioned in section 9ZF(1), and with respect to any sums paid on account of such expenses.

5E+WAny temporary stop notice served by the Welsh Ministers with respect to the monument ceases to have effect, in so far as the notice relates to works affecting anything in respect of which the interim protection had effect.

6E+WAny proceedings on an application made by the Welsh Ministers under section 9ZM with respect to the monument lapse, in so far as they relate to the restraint of any actual or apprehended contravention in relation to anything in respect of which the interim protection had effect.]

[F1SCHEDULE A2E+WDECISIONS ON REVIEWS BY PERSON APPOINTED BY WELSH MINISTERS

Decisions on reviews by appointed personsE+W

1(1)The Welsh Ministers may by regulations prescribe the classes of reviews under section 1AE on which a decision is to be made by a person appointed by the Welsh Ministers for the purpose instead of by the Welsh Ministers.E+W

(2)Decisions on reviews of a prescribed class are to be made accordingly.

(3)This paragraph does not affect any provision in this Act or any instrument made under it that an application for a review is to be made to the Welsh Ministers.

(4)A person appointed under this paragraph is referred to in this Schedule as “an appointed person”.

Powers and duties of appointed personE+W

2(1)An appointed person has the same powers and duties in relation to a review under section 1AE as the Welsh Ministers have under—E+W

(a)subsections (3)(a) and (b) and (5) of that section; and

(b)regulations made by virtue of subsection (7) of that section.

(2)Where an appointed person makes a decision on a review, the decision is to be treated as that of the Welsh Ministers.

(3)Except as provided by section 55, the validity of that decision is not to be questioned in any legal proceedings.

(4)No application may be made to the High Court under section 55 on the ground that a decision on a review ought to have been made by the Welsh Ministers and not by an appointed person unless the person who made the application for the review challenges the appointed person's power to make the decision before the decision is made.

Appointment of another person to make a decision on a reviewE+W

3(1)At any time before an appointed person has made a decision on a review under section 1AE the Welsh Ministers may—E+W

(a)revoke the person's appointment; and

(b)appoint another person under paragraph 1 to make the decision instead.

(2)Where such a new appointment is made, the review, and any inquiry or other hearing in connection with the review, must be begun afresh.

(3)Nothing in sub-paragraph (2) requires any person to be given an opportunity to make fresh representations or to modify or withdraw any representations already made.

Public local inquiries, hearings and written representationsE+W

4(1)An appointed person may appoint an assessor to provide advice on—E+W

(a)any matters arising at a public local inquiry or hearing held by the appointed person in connection with a review under section 1AE or in consequence of such an inquiry or hearing; or

(b)any matters arising in written representations made to the appointed person in connection with such a review or in consequence of such representations.

(2)Section 250(2) and (3) of the Local Government Act 1972 (local inquiries: evidence) applies to a public local inquiry held by an appointed person.

DirectionsE+W

5(1)The Welsh Ministers may direct that anything that would fall to be done by an appointed person in connection with a review under section 1AE, other than the making of a decision on the review under subsection (3)(b) of that section, is to be done instead by the Welsh Ministers.E+W

(2)A direction given under sub-paragraph (1) may be amended or withdrawn by a further direction.

DelegationE+W

6(1)An appointed person may delegate to another person anything that would fall to be done by the appointed person in connection with a review under section 1AE, other than—E+W

(a)the conduct of a public local inquiry or hearing; and

(b)the making of a decision on the review under subsection (3)(b) of that section.

(2)A delegation under sub-paragraph (1) is to be to the extent, and on the terms, that the appointed person determines and may be amended or revoked.

Supplementary provisionE+W

7E+WWhere an appointed person is a member of the staff of the Welsh Government, the functions of making a decision on a review and doing anything in connection with it conferred on the person by this Schedule are to be treated for the purposes of [F2the Public Services Ombudsman (Wales) Act 2005 and the Public Services Ombudsman (Wales) Act 2019] as functions of the Welsh Government.]

SCHEDULE 1E+W+S Control of Works Affecting Scheduled Monuments

Part IE+W+S Applications for Scheduled Monument Consent

1(1)Provision may be made by regulations under this Act with respect to the form and manner in which applications for scheduled monument consent are to be made, the particulars to be included therein and the information to be provided by applicants or (as the case may be) by [F3the Secretary of State] [F3Historic Environment Scotland] in connection therewith.E+W+S

[F4(1A)The Scottish Ministers may by regulations make provision as to—

(a)the manner in which scheduled monument consent is to be granted;

(b)the form and content of scheduled monument consent.]

(2)Any scheduled monument consent (including scheduled monument consent granted by order under section 3 of this Act) shall (except so far as it otherwise provides) enure for the benefit of the monument and of all persons for the time being interested therein.

[F5(3)The Welsh Ministers may by regulations make provision as to cases in which an applicant for scheduled monument consent in relation to a monument situated in Wales may make the application otherwise than in the form provided for under sub-paragraph (1); and such provision may confer a discretion on the Welsh Ministers.]

2(1)[F6The Secretary of State may refuse to entertain an application for scheduled monument consent unless it is accompanied by one or other of the following certificates signed by or on behalf of the applicant, that is to say—E+W+S

(a)a certificate stating that, at the beginning of the period of twenty-one days ending with the application, no person other than the applicant was the owner of the monument;

(b)a certificate stating that the applicant has given the requisite notice of the application to all the persons other than the applicant who, at the beginning of that period, were owners of the monument;

(c)a certificate stating that the applicant is unable to issue a certificate in accordance with either of the preceding paragraphs, that he has given the requisite notice of the application to such one or more of the persons mentioned in paragraph (b) above as are specified in the certificate, that he has taken such steps as are reasonably open to him to ascertain the names and addresses of the remainder of those persons and that he has been unable to do so;

(d)a certificate stating that the applicant is unable to issue a certificate in accordance with paragraph (a) above, that he has taken such steps as are reasonably open to him to ascertain the names and addresses of the persons mentioned in paragraph (b) above and that he has been unable to do so.]

[F6[F7Historic Environment Scotland] may refuse to entertain an application for scheduled monument consent unless it is accompanied by a certificate as to the interests in the monument to which the application relates.]

[F6(2)Any certificate issued for the purposes of sub-paragraph (1) above—

(a)shall contain such further particulars of the matters to which the certificate relates as may be prescribed by regulations made for the purposes of this paragraph; and

(b)shall be in such form as may be so prescribed;

and any reference in that sub-paragraph to the requisite notice is a reference to a notice in the form so prescribed.]

[F6The Scottish Ministers may by regulations—

(a)make provision as to the notice of any application for scheduled monument consent to be given to any person (other than the applicant) who, at the beginning of the period of 21 days ending with the date of the application, was the owner of the monument;

(b)make provision for publicising applications for scheduled monument consent;

(c)make provision as to—

(i)the form and content of certificates such as are mentioned in sub-paragraph (1) and notices such as are mentioned in paragraph (a);

(ii)service of such notices;

(d)make provision as to such further particulars of the matters to which such certificates relate as may be prescribed;

(e)require an applicant for scheduled monument consent to certify, in such form as may be prescribed, or to provide evidence, that any requirements of the regulations have been satisfied.

(2A)Regulations under sub-paragraph (2) may make different provision for different classes of case.]

(3)Regulations made for the purposes of this paragraph may make provision as to who, in the case of any monument, is to be treated as the owner for those purposes.

(4)If any person issues a certificate which purports to comply with the requirements of this paragraph [F8or of regulations made by the Welsh Ministers under it] [F9or regulations made under it] and which contains a statement which he knows to be false or misleading in a material particular, or recklessly issues a certificate which purports to comply with those requirements and which contains a statement which is false or misleading in a material particular, he shall be guilty of an offence and liable on summary conviction or, in Scotland, on conviction before a court of summary jurisdiction, to a fine not exceeding [F10level 3 on the standard scale].

[F122B(1)The Welsh Ministers may refuse to entertain an application for scheduled monument consent if—E+W

(a)within the period of 2 years ending with the date on which the application is received, the Welsh Ministers have refused a similar application; and

(b)in their opinion, there has been no significant change in any material considerations since the similar application was refused.

(2)The Welsh Ministers may refuse to entertain an application for scheduled monument consent if the application is made at a time when a similar application is under consideration.

(3)For the purposes of this paragraph, an application for scheduled monument consent is to be taken to be similar to another such application only if the works to which the applications relate are, in the Welsh Ministers' opinion, the same or substantially the same.]

[F132C(1)If Historic Environment Scotland, on an application to it for scheduled monument consent, intends to grant that consent, it must, where sub-paragraph (2) applies, first notify the Scottish Ministers of the application.S

(2)This sub-paragraph applies where—

(a)regulations, or

(b)directions given to Historic Environment Scotland by the Scottish Ministers,

provide that the application must be so notified.

(3)The Scottish Ministers may within the period of 28 days beginning with the date of the notification—

(a)direct the reference of the application to them under section 3B, or

(b)give notice to Historic Environment Scotland that they require further time in which to consider whether to require such a reference.

(4)Historic Environment Scotland must not grant scheduled monument consent until—

(a)the period mentioned in sub-paragraph (3) has expired without the Scottish Ministers directing the reference of the application to them or giving notice under paragraph (b) of that sub-paragraph, or

(b)the Scottish Ministers have notified Historic Environment Scotland that they do not intend to require the reference of the application.

2DSThe Scottish Ministers may give directions to Historic Environment Scotland requiring it, in such cases or classes of case as may be specified in the directions, to notify to Ministers and to such other persons as may be so specified—

(a)any applications made to it for scheduled monument consent, and

(b)the decisions taken on those applications.]

3(1)The Secretary of State [F14or Historic Environment Scotland] may grant scheduled monument consent in respect of all or any part of the works to which an application for scheduled monument consent relates.E+W+S

[F15(2)Before determining whether or not to grant scheduled monument consent on any application therefor, the Secretary of State shall either—

(a)cause a public local inquiry to be held; or

(b)afford to the applicant, and to any other person to whom it appears to the Secretary of State expedient to afford it, an opportunity of appearing before and being heard by a person appointed by the Secretary of State for the purpose.]

[F15The Scottish Ministers may by regulations make provision for the procedure to be followed by Historic Environment Scotland in considering and determining applications for scheduled monument consent.]

[F15(3)Before determining whether or not to grant scheduled monument consent on any application therefor the Secretary of State—

(a)shall in every case consider any representations made by any person with respect to that application before the time when he considers his decision thereon (whether in consequence of any notice given to that person in accordance with any requirements of regulations made by virtue of paragraph 2 above or of any publicity given to the application by the Secretary of State, or otherwise); and

(b)shall also, if any inquiry or hearing has been held in accordance with sub-paragraph (2) above, consider the report of the person who held it. [F16and

(c)shall, if the monument in question is situated in England, consult with the Commission.]

(4)The Secretary of State [F17or, as the case may be, Historic Environment Scotland] shall serve notice of [F18his] [F18the] decision with respect to the application on the applicant and on every person who has made representations [F19to him] with respect to the application.]

[F20(5)This paragraph does not apply to applications for scheduled monument consent in respect of works to a scheduled monument situated in Wales.]

(2)The Welsh Ministers may grant scheduled monument consent in respect of all or any part of the works to which an application relates.

(3)Before determining whether or not to grant scheduled monument consent on an application, the Welsh Ministers may—

(a)cause a public local inquiry to be held; or

(b)afford to the applicant, and to any other person to whom it appears to the Welsh Ministers expedient to do so—

(i)an opportunity to appear before and be heard by a person appointed by the Welsh Ministers for that purpose; or

(ii)an opportunity to make representations to a person appointed by the Welsh Ministers for that purpose.

(4)Before determining whether or not to grant scheduled monument consent on an application, the Welsh Ministers—

(a)must, in every case, consider any representations made by any person with respect to that application; and

(b)must also, if an inquiry or hearing has been held or representations have been made in accordance with sub-paragraph (3), consider the report of the person who held the inquiry or hearing or to whom the representations were made.

(5)The Welsh Ministers must serve notice of their decision with respect to the application on the applicant and on every person who has made representations with respect to the application.]

Part IIE+W+S Modification and Revocation of Scheduled Monument Consent

5[F23(1)Before giving a direction under section 4 of this Act modifying or revoking a scheduled monument consent the Secretary of State shall serve a notice of proposed modification or revocation on—E+W+S

(a)the owner of the monument and (if the owner is not the occupier) the occupier of the monument; and

(b)any other person who in the opinion of the Secretary of State would be affected by the proposed modification or revocation.

[F24(1A)Where the monument in question is situated in England, the Secretary of State shall consult with the Commission before serving a notice under this paragraph, and on serving such a notice he shall send a copy of it to the Commission.]

(2)A notice under this paragraph shall—

(a)contain a draft of the proposed modification or revocation and a brief statement of the reasons therefor; and

(b)specify the time allowed by sub-paragraph (5) below for making objections to the proposed modification or revocation and the manner in which any such objections can be made.

(3)Where the effect of a proposed modification (or any part of it) would be to exclude any works from the scope of the scheduled monument consent in question or in any manner to affect the execution of any of the works to which the consent relates, the notice under this paragraph relating to that proposed modification shall indicate that the works affected must not be executed after the receipt of the notice or (as the case may require) must not be so executed in a manner specified in the notice.

(4)A notice of proposed revocation under this paragraph shall indicate that the works to which the scheduled monument consent in question relates must not be executed after receipt of the notice.

(5)A person served with a notice under this paragraph may make an objection to the proposed modification or revocation at any time before the end of the period of twenty-eight days beginning with the date on which the notice was served.]

(4)Before determining in a case within sub-paragraph (2) above whether to give a direction under section 4 of this Act modifying or revoking the scheduled monument consent in accordance with the notice, the Secretary of State—

(a)shall in every case consider any objections duly made as mentioned in sub-paragraph (1) above and not withdrawn; and

(b)shall also, if any inquiry or hearing has been held in accordance with sub-paragraph (2) above, consider the report of the person who held it.

(5)After considering any objections and report he is required to consider in accordance with sub-paragraph (4) above the Secretary of State may give a direction under section 4 of this Act modifying or revoking the scheduled monument consent either in accordance with the notice or with any variation appearing to him to be appropriate.]

(b)if within that period the Secretary of State serves notice on the occupier or (if there is no occupier) on the owner of the monument that he has determined not to give such a direction, on the date when he serves that notice; and

(c)in any other case, at the end of that period.

(5)In this paragraph “the relevant service date” means, in relation to a notice under paragraph 5 above with respect to works affecting any monument, the date on which that notice was served on the occupier or (if there is no occupier) on the owner of the monument.]

11(1)Where sub-paragraph (2) applies, Historic Environment Scotland—S

(a)need not submit the order under section 4 modifying or revoking the scheduled monument consent to the Scottish Ministers for approval,

(b)must instead take the steps mentioned in sub-paragraph (3).

(2)This sub-paragraph applies where—

(a)the owner of the scheduled monument affected,

(b)where the owner is not the occupier of the monument, the occupier, and

(c)all other persons who in Historic Environment Scotland's opinion will be affected by the order,

have notified Historic Environment Scotland in writing that they do not object to the order.

(3)The steps referred to in sub-paragraph (1)(b) are—

(a)advertising in the prescribed manner the fact that the order has been made,

(b)serving notice to the same effect on the persons mentioned in sub-paragraph (2), and

(c)sending a copy of any such advertisement to the Scottish Ministers not more than 3 days after its publication.

(4)The advertisement under sub-paragraph (3)(a) must specify—

(a)the period within which persons affected by the order may give notice to the Scottish Ministers that they require an opportunity of appearing before and being heard by a person appointed by the Scottish Ministers for the purpose, and

(b)the period at the end of which, if no such notice is given to the Scottish Ministers, the order may take effect by virtue of this paragraph and without being confirmed by the Scottish Ministers.

(5)The period referred to in sub-paragraph (4)(a) must not be less than 28 days from the date on which the advertisement first appears.

(6)The period referred to in sub-paragraph (4)(b) must not be less than 14 days from the end of the period referred to in sub-paragraph (4)(a).

(7)The notice under sub-paragraph (3)(b) must include a statement to the effect that no compensation is payable under section 9 in respect of an order which takes effect by virtue of this paragraph.

(8)The order takes effect at the end of the period referred to in sub-paragraph (4)(b) without being confirmed by the Scottish Ministers if—

(a)no person claiming to be affected by the order has given notice to the Scottish Ministers as mentioned in sub-paragraph (4)(a) within the period referred to in that sub-paragraph, and

(b)the Scottish Ministers have not directed that the order be submitted to them for confirmation.]

Determination of appeals by appointed personS

1(1)The Scottish Ministers may by regulations prescribe classes of appeals under sections 1C, 4B and 9C which are to be determined by a person appointed by the Scottish Ministers for the purpose.S

(2)Those classes of appeals are to be so determined except in such classes of case—

(a)as may for the time being be prescribed, or

(b)as may be specified in directions given by the Scottish Ministers.

(3)Regulations under sub-paragraph (1) may provide for the giving of publicity to any directions given by the Scottish Ministers under this paragraph.

(4)This paragraph does not affect any provision made by or under this Act that an appeal is to lie to, or a notice of an appeal is to be served on, the Scottish Ministers.

(5)A person appointed under this paragraph is referred to in this schedule as an “appointed person”.

Powers and duties of appointed personS

2(1)An appointed person is to have the same powers and duties—S

(a)in relation to an appeal under section 1C as the Scottish Ministers have under section 1D,

(b)in relation to an appeal under section 4B as the Scottish Ministers have under section 4C,

(c)in relation to an appeal under section 9C as the Scottish Ministers have under section 9CA.

(2)Where an appeal has been determined by an appointed person, the decision is to be treated as a decision of the Scottish Ministers.

(3)Except as provided for by section 55, the decision of an appointed person on any appeal is final.

Determination of appeals by the Scottish MinistersS

3(1)The Scottish Ministers may, if they think fit, direct that an appeal which would otherwise fall to be determined by an appointed person is instead to be determined by them.S

(2)Such a direction must—

(a)state the reasons for which it is given, and

(b)be served on the appellant.

(3)Where an appeal under section 1C, 4B or 9C falls to be determined by the Scottish Ministers by virtue of a direction under this paragraph, the provisions of this Act which are relevant to the appeal are to apply, subject to sub-paragraph (4), as if this schedule had never applied to it.

(4)In determining the appeal, the Scottish Ministers may take into account any report made to them by any person previously appointed to determine the appeal.

4(1)The Scottish Ministers may by a further direction revoke a direction under paragraph 3 at any time before the determination of the appeal.S

(2)Such a further direction must—

(a)state the reasons for which it is given, and

(b)be served on—

(i)the person, if any, previously appointed to determine the appeal, and

(ii)the appellant.

(3)Where such a further direction has been given, the provisions of this schedule relevant to the appeal are to apply, subject to sub-paragraph (4), as if no direction under paragraph 3 had been given.

(4)Anything done by or on behalf of the Scottish Ministers in connection with the appeal which might have been done by the appointed person (including any arrangements made for the holding of a hearing or local inquiry) is, unless that person directs otherwise, to be treated as having been done by that person.

Appointment of another person to determine appealS

5(1)At any time before the appointed person has determined the appeal the Scottish Ministers may—S

(a)revoke the appointment, and

(b)appoint another person under paragraph 1 to determine the appeal instead.

(2)Where such a new appointment is made, the consideration of the appeal or any inquiry or other hearing in connection with it is to be begun afresh.

(3)Nothing in sub-paragraph (2) requires any person to be given an opportunity of making fresh representations or modifying or withdrawing any representations already made.

Local inquiries and hearingsS

6(1)Whether or not the parties to an appeal have asked for an opportunity to appear and be heard, an appointed person—S

(a)may hold a local inquiry in connection with the appeal, and

(b)must do so if the Scottish Ministers so direct.

(2)Where an appointed person—

(a)holds a hearing, or

(b)holds an inquiry by virtue of this paragraph,

an assessor may be appointed by the Scottish Ministers to sit with the appointed person at the hearing or inquiry to advise the appointed person on any matters arising.

(3)Subject to sub-paragraph (4), the expenses of any such hearing or inquiry are to be paid by the Scottish Ministers.

(4)Subsections (4) to (13) of section 265 of the Town and Country Planning (Scotland) Act 1997 (c.8) apply to an inquiry held under this paragraph as they apply to an inquiry held under that section.

(5)The appointed person has the same power to make orders under subsection (9) of that section in relation to proceedings under this schedule which do not give rise to an inquiry as the person has in relation to such an inquiry.

(6)For the purposes of this paragraph, references to the Minister in subsections (9) and (12) of that section are to be read as references to the appointed person.

Supplementary provisionsS

7SThe functions of determining an appeal and doing anything in connection with it conferred by this schedule on an appointed person who is a member of the staff of the Scottish Administration are to be treated for the purposes of the Scottish Public Services Ombudsman Act 2002 (asp 11) as functions conferred on the Scottish Ministers.]

Section 33.

SCHEDULE 2E+W+S Designation Orders

Designation orders by the Secretary of StateE+W+S

1(1)A designation order made by the Secretary of State shall describe by reference to a map the area affected.E+W+S

(2)The map shall be to such a scale, and the order in such form, as the Secretary of State considers appropriate.

2E+W+SBefore making a designation order the Secretary of State shall—

(a)consult each of the local authorities concerned; and

[F27(aa)consult with the Commission (if the area which would be designated by the order is situated in England); and]

(b)publish notice of his proposal to make the order;

in accordance with paragraph 3 below.

3(1)The [F28consultations required by sub-paragraphs (a)(aa)] of paragraph 2 above shall precede the publication of the notice required by sub-paragraph (b) of that paragraph.E+W+S

(2)The notice required by paragraph 2(b) above—

(a)shall be published in two successive weeks in the London Gazette and in one or more local newspapers circulating in the locality in which the area affected is situated;

(b)shall state that the Secretary of State proposes to make the order, describing the area affected and the effect of the order; and

(c)shall indicate where (in accordance with paragraphs 4 and 5 below) a copy of the draft order and of the map to which it refers may be inspected.

4E+W+SCopies of the draft order and of the map to which it refers—

(a)shall be deposited with each of the local authorities concerned on or before the date on which notice of the Secretary of State’s proposal to make the order is first published in accordance with paragraph 3(2)(a) above; and

[F29(aa)shall be sent to the Commission (if the area which would be designated by the order is situated in England); and]

(b)shall be kept available for public inspection by each of those authorities, free of charge, at reasonable hours and at a convenient place, until the Secretary of State makes the order or notifies the local authority in question that he has determined not to make it.

(2)The notice required by paragraph 9(b) above shall be in the prescribed form and shall otherwise comply with paragraph 3(2) above (with the necessary modifications).

11E+W+SCopies of the draft order and of the map to which it refers—

(a)shall be deposited with each of the local authorities concerned (other than the local authority proposing to make the order) on or before the date on which notice of the proposal to make the order is first published in accordance with paragraph 3(2)(a) above as applied by paragraph 10 above; and

(b)shall be kept available for public inspection by each of the local authorities concerned, free of charge at reasonable hours and at a convenient place, until the local authority proposing to make the order either make it or determine not to make it and, in the case of any other local authority concerned, notify that local authority of their determination.

12E+W+SThe local authority may make the order, either without modifications or with such modification only as consists in reducing the area affected, and submit it to the Secretary of State for confirmation, at any time after the end of the period of six weeks beginning with the date on which notice of their proposal to make the order is first published in accordance with paragraph 3(2)(a) above as applied by paragraph 10 above.

13E+W+SA designation order made by a local authority shall not take effect unless it is confirmed by the Secretary of State, and the Secretary of State may confirm any such order either without modifications or with such modification only as consists in reducing the area affected.

14E+W+SIf the Secretary of State confirms the order the local authority shall on being notified that the order has been confirmed—

(a)publish notice of the making of the order in the manner and form prescribed; and

(b)deposit a copy of the order and of the map to which it refers with any other local authority concerned. [F32and

(c)send to the Commission a copy of the order and of the map to which it refers, if the area designated is situated in England.]

15E+W+SThe Secretary of State may by regulations prescribe the procedure to be followed by a local authority in submitting a designation order for confirmation by the Secretary of State.

[F3415AE+W+S Paragraphs 8, 9, 10 to 13, 14( a ) and ( b ) and 15 above shall have effect in relation to a designation order made by the Commission as if—

(a)in paragraphs 8(1), 12, 13 and 15 the references to a local authority were a reference to the Commission;

(b)in paragraphs 9 and 14 the first reference to a local authority were a reference to the Commission, and the word “other” were omitted; and

(c)in paragraph 11—

(i)in sub-paragraph (a) the words in brackets were omitted; and

(ii)in sub-paragraph (b) the reference to the local authority proposing to make the order were a reference to the Commission, and the word “other” were omitted.]

Operation of designation ordersE+W+S

16(1)A designation order made by the Secretary of State shall not come into operation until the end of the period of six months beginning with the date on which it is made.E+W+S

(2)A designation order made by a local authority and confirmed by the Secretary of State shall not come into operation until the end of the period of six months beginning with the date on which it is confirmed.

Variation and revocation of designation ordersE+W+S

17(1)An order varying or revoking a designation order shall describe by reference to a map the area affected by the designation order and (in the case of an order varying a designation order) the reduction of that area made by the order.E+W+S

(2)The map shall be to such a scale, and the order in such form, as the Secretary of State considers appropriate.

18E+W+SBefore and on making an order varying or revoking a designation order the Secretary of State shall follow the procedure laid down for the making by him of a designation order, and paragraphs 2 to 7 above shall accordingly apply in any such case (taking references to the area affected as references to the area affected by the designation order).

19E+W+SIn relation to a designation order relating to an area in Scotland, references in this Schedule to the London Gazette shall be construed as references to the Edinburgh Gazette.

InterpretationE+W+S

20(1)In this Schedule “the area affected” means, in relation to a designation order, the area to which the order for the time being relates.E+W+S

(2)For the purposes of this Schedule a local authority is a local authority concerned in relation to a designation order (or in relation to an order varying or revoking a designation order) if the area affected by the designation order, or any part of that area, is within the area of that local authority.

SCHEDULE 3E+W+S Transitional Provisions

1(1)Where an interim preservation notice is in force with respect to any monument immediately before the commencement of this Act, sections 10(3)(a) and (c) and 12(1), (2)(b), (3)(b) and (4) of the M6Historic Buildings and Ancient Monuments Act 1953 shall continue to apply to the notice and monument respectively as if this Act had not been passed, unless and until the monument is included in the Schedule under section 1(3) of this Act.E+W+S

(2)So long as by virtue of sub-paragraph (1) above section 12(1) of the Historic Buildings and Ancient Monuments Act 1953 continues to apply after the commencement of this Act to any monument which is under guardianship by virtue of this Act, section 28 of this Act shall have effect in relation to that monument as if for the reference in subsection (2) of that section to a scheduled monument consent there were substituted a reference to the consent of the Secretary of State under section 12(1).

2(1)Subject to sub-paragraph (2) below, where a guardianship order made under section 12(5) of the M7Historic Buildings and Ancient Monuments Act 1953 is in force immediately before the commencement of this Act that order shall continue in force notwithstanding the repeal by this Act of section 12(5), and the provisions of this Act shall apply while the order is in force as if the Secretary of State had been constituted guardian of the monument by a deed not containing any restriction not contained in the order and executed by all the persons who, at the time when the order was made, were able by deed to constitute the Secretary of State guardian of the monument.E+W+S

(2)A guardianship order continued in force by this paragraph may be revoked at any time by the Secretary of State.

3(1)Where within the period of three months immediately preceding the commencement of this Act a person has given notice in accordance with section 6(2) of the M8Ancient Monuments Act 1931 of his intention to execute or permit to be executed any such work in relation to a monument as is there mentioned the notice shall have effect for the purposes of this Act as an application for scheduled monument consent for the execution of that work.E+W+S

(2)Where—

(a)a monument becomes a scheduled monument under this Act; and

(b)before it is included in the Schedule any person has applied for the consent of the Secretary of State for the execution of any works affecting the monument which would otherwise be prohibited by section 12(1) of the M9Historic Buildings and Ancient Monuments Act 1953 (consent required for certain works in relation to a monument subject to an interim preservation notice or preservation order);

then, in a case where the Secretary of State’s decision on the application has not been notified to the person in question before the monument is included in the Schedule, the application shall have effect for the purposes of this Act as an application for scheduled monument consent for the execution of those works.

(3)The Secretary of State shall consider and determine any application for scheduled monument consent which has effect as such by virtue of this paragraph notwithstanding that any requirements of regulations made by virtue of paragraph 1 or any requirements of paragraph 2 of Schedule 1 to this Act are not satisfied in relation to that application.

4(1)Subject to the following provisions of this paragraph, where a person has given notice as mentioned in paragraph 3(1) above with respect to any work more than three months before the commencement of this Act, the notice shall have effect for the purposes of this Act as if it were a scheduled monument consent for the execution of that work granted by the Secretary of State under section 2 of this Act on the date of the commencement of this Act (and it may be modified or revoked by the Secretary of State under section 4 of this Act accordingly).E+W+S

(2)This paragraph does not apply in any case where an interim preservation notice or a preservation order is in force with respect to the monument in question immediately before the commencement of this Act.

(3)A scheduled monument consent which has effect as such by virtue of this paragraph shall not cease to have effect by virtue of section 4(1) of this Act if any of the work to which it relates has been executed or started before the commencement of this Act.

5(1)Subject to sub-paragraph (2) below, where—E+W+S

(a)a monument becomes a scheduled monument under this Act; and

(b)before it is included in the Schedule the Secretary of State has granted consent for the execution of any works affecting the monument under section 12(1) of the M10Historic Buildings and Ancient Monuments Act 1953;

that consent shall have effect for the purposes of this Act as if it were a scheduled monument consent for the execution of those works granted by the Secretary of State under section 2 of this Act on the date when the monument became a scheduled monument (and it may be modified or revoked by the Secretary of State under section 4 of this Act accordingly).

(2)A scheduled monument consent which has effect as such by virtue of this paragraph shall not cease to have effect by virtue of section 4(1) of this Act if any of the works to which it relates have been executed or started before the monument becomes a scheduled monument.

6(1)[F35Section 13(2) of this Act shall not apply to any monument of which the Secretary of State or a local authority have been constituted guardians before the commencement of this Act, except where either—E+W+S

(a)the guardianship deed provided for control and management of the monument by the guardians; or

(b)the persons for the time being immediately affected by the operation of the guardianship deed have consented to the exercise of control and management of the monument by the guardians.]

(2)Section 19(1) of this Act shall not apply to any monument of which the M11Secretary of State or a local authority had been constituted guardians before 15th August 1913 (being the date of commencement of the Ancient Monuments Consolidation and Amendment Act 1913), except where either—

(a)the guardianship deed provided for public access to the monument; or

(b)the persons for the time being immediately affected by the operation of the guardianship deed have consented to the public having access to the monument.

(3)Where any land adjoining or adjacent to a monument (in addition to its site) was acquired or taken into guardianship before the commencement of this Act under any enactment repealed by this Act, it shall be regarded for the purposes of this Act as having been acquired or taken into guardianship for a purpose relating to that monument by virtue of section 15 of this Act.
