The Secretary of State makes these Regulations in exercise of the powers conferred by—
(a)section 2(2) of the European Communities Act 1972(1);
(b)section 8(1) of, and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018(2).
The Secretary of State has been designated for the purposes of section 2(2) of the European Communities Act 1972 in relation to the environment(3), the prevention, reduction and elimination of pollution caused by waste(4) and the control of the import and export of goods(5).
In accordance with paragraph 2(2) of Schedule 2 to the European Communities Act 1972 and paragraph 1(3) of Schedule 7 to the European Union (Withdrawal) Act 2018, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
1972 c. 68; section 2(2) was amended by section 27(1)(a) of the Legislative and Regulatory Reform Act 2006 (c. 51) and by Part 1 of the Schedule to the European Union (Amendment) Act 2008 (c. 7). The European Communities Act 1972 Act is repealed with effect from exit day by section 1 of the European Union (Withdrawal) Act 2018.
