Whereas:

(1) by paragraph 3(1)(a) of Schedule 8 to the Terrorism Act 2000(1) “the 2000 Act”) the Secretary of State is required to issue a code of practice in connection with the audio recording of any interview by a constable of a person detained under Schedule 7 to or section 41 of the 2000 Act if the interview takes place in a police station;

(2) pursuant to paragraph 4(2) of Schedule 8 to the 2000 Act, the Secretary of State has published a draft of the code of practice in connection with the above matter and has considered representations made to him about it and modified it as he thinks appropriate;

(3) pursuant to paragraph 4(3) of Schedule 8 to the 2000 Act, the Secretary of State has laid a draft of the code of practice before Parliament;

Now, therefore, in exercise of the power conferred upon him by paragraph 4(4) of Schedule 8 to the 2000 Act the Secretary of State makes the following Order, a draft of which has been laid before Parliament in accordance with section 123(4)(k) of the 2000 Act and approved by resolution of each House of Parliament:

Citation and commencement

1.  This Order may be cited as the Terrorism Act 2000 (Code of Practice on Audio Recording of Interviews) Order 2001 and shall come into force on 19th February 2001.

Code of practice

2.  The code of practice in connection with the audio recording of any interview by a constable of a person detained under Schedule 7 to or section 41 of the 2000 Act if the interview takes place in a police station (within the meaning of paragraph 1(2) of Schedule 8 to the 2000 Act), which was laid before Parliament in draft on 14th December 2000, shall come into operation on 19th February 2001.

Explanatory Note

(This note is not part of the Order)

This Order appoints 19th February as the date on which the code of practice on the audio recording of interviews by police officers of persons detained in a police station under the Terrorism Act 2000 comes into operation. `Police station' includes any place which the Secretary of State has designated under paragraph 1(1) of Schedule 8 to the Terrorism Act 2000 as a place where a person may be detained under section 41 of that Act.
