Continuity of qualifying Scottish marriages

12. For the avoidance of doubt nothing in these Regulations affects the continuity of a qualifying Scottish marriage(1).

Section 11C of the 2004 Act provides that the continuity of a protected Scottish marriage is not affected by the issue of a full gender recognition certificate. “Protected Scottish marriage” is defined at section 25(1) of the 2004 Act as a marriage solemnised in Scotland.
