Permanent grassland

17.—(1) For the purposes of the first sub-paragraph of Article 45(1) of the Direct Payments Regulation, areas of permanent grassland are designated as environmentally sensitive where those areas are located in a site of special scientific interest as mentioned in the list published by the Scottish Ministers(1) and these areas have not been ploughed or converted within a period of 15 calendar years ending on 31st December 2014.
(2) In this regulation, “site of special scientific interest” has the meaning given by section 58 (interpretation) of the Nature Conservation (Scotland) Act 2004(2).
