159.—(1) Paragraph (2) applies if, when a person dies, the total amount due to that person’s executors under this scheme (including anything due at that person’s death) does not exceed the amount specified in any order for the time being in force under section 6 of the Administration of Estates (Small Payments) Act 1965(1) and applying in relation to that person’s death.
(2) A scheme manager may pay the whole or part of the amount due to—
(a)a person’s executors; or
(b)any person or persons appearing to the scheme manager to be beneficially entitled to the estate,
without the production of a grant of confirmation to the person’s estate.
1965 c.32; there are amendments to section 6 which are not relevant to this instrument.
