The Scottish Ministers make the following Order in exercise of the powers conferred on them by section 87 of the Natural Environment and Rural Communities Act 2006(1), and all other powers enabling them to do so.

In accordance with section 97(5) of that Act they have consulted with such organisations as appear to them to be representative of interests substantially affected by this Order.

In accordance with section 97(8) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Quality Meat Scotland (Amendment) Order 2023 and comes into force on 22 December 2023.

(2) In this Order, “the Order” means the Quality Meat Scotland Order 2008(2).

Amendment of the Quality Meat Scotland Order 2008

2.  The Quality Meat Scotland Order 2008 is amended in accordance with articles 3 and 4.

Amendment of the maximum rate of producer levy

3.  In the table in paragraph 7 (maximum rate of producer levy) of schedule 3 (levies: cattle, sheep and pigs)—

(a)for “£5.25” substitute “£9.00”,

(b)for “£0.60” substitute “£1.50”,

(c)for “£1.075” substitute “£2.40”.

Amendment of the maximum rate of slaughterer or exporter levy

4.  In the table in paragraph 8 (maximum rate of slaughterer or exporter levy) of schedule 3—

(a)for “£1.75” substitute “£3.00”,

(b)for “£0.20” substitute “£0.50”,

(c)for “£0.275” substitute “£0.60”.

The purpose for which levies are imposed

5.  The levies which may be imposed by Quality Meat Scotland under article 6 (levies) and schedule 3 of the Order are to enable Quality Meat Scotland to—

(a)meet its expenses in the exercise of its functions,

(b)meet its administrative expenses,

(c)further a purpose in article 3(2) (purposes of Quality Meat Scotland) of the Order,

(d)establish a reserve fund.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Quality Meat Scotland Order 2008 (“the 2008 Order”) which establishes Quality Meat Scotland and which confers power on Quality Meat Scotland to impose levies on people who slaughter or export cattle, sheep, or pigs. The maximum rates of levy are specified in schedule 3 of the 2008 Order.

This Order comes into force on 22 December 2023.

Article 3 amends the maximum rate of producer levy.

Article 4 amends the maximum rate of slaughterer or exporter levy.

Article 5 states the purpose for which any levies are imposed, as required by paragraph 5(3) of schedule 10 of the Natural Environment and Rural Communities Act 2006.

No business and regulatory impact assessment has been prepared for this Order as no impact upon business, charities or voluntary bodies is foreseen.
