The Department for Infrastructure(1) makes the following Order in exercise of the powers conferred by Article 59(1) of the Road Traffic Offenders (Northern Ireland) Order 1996(2) and now vested in it(3).

In accordance with Article 91(1) of that Order the Department has consulted with such representative organisations as it thinks fit.

Citation and commencementN.I.

1.  This Order may be cited as the Road Traffic (Fixed Penalty) (Amendment) Order (Northern Ireland) 2023 and shall come into operation on 15th May 2023.

2.  In Schedule 1 to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007(4) (fixed penalties), after item 25 insert—

25A.A fixed penalty offence under Article 12 of the Road Traffic (Northern Ireland) Order 1995£100.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends Schedule 1 to the Road Traffic (Fixed Penalty) Order (Northern Ireland) 2007 by inserting an amount of £100 for the fixed penalty prescribed for the offence under Article 12 of the Road Traffic (Northern Ireland) Order 1995.

The new fixed penalty relates to the offence of driving a mechanically propelled vehicle on a road or other public place without due care and attention, or without reasonable consideration for other persons using the road or place.

An Explanatory Memorandum has been produced and is available from Safe and Accessible Travel Division, Department for Infrastructure, Clarence Court, 10-18 Adelaide Street, Town Parks, Belfast BT2 8GB or online alongside this Statutory Rule at http://www.legislation.gov.uk/nisr.
