The Department of Agriculture, Environment and Rural Affairs makes these Regulations in exercise of the powers conferred by sections 48 and 50(3)(a) of, and paragraph 5 of Schedule 6 to, the Agriculture Act 2020(1).

Citation, commencement and interpretationN.I.

1.—(1) These Regulations may be cited as the Direct Payments to Farmers (Cross-Compliance) (Amendment) Regulations (Northern Ireland) 2023 and shall come into operation on 1st January 2024.

(2) The Interpretation Act (Northern Ireland) 1954(2) shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of The Direct Payments to Farmers (Cross-Compliance) (Amendment) Regulations (Northern Ireland) 2022N.I.

2.—(1) The Direct Payments to Farmers (Cross-Compliance) (Amendment) Regulations (Northern Ireland) 2022(3) are amended as follows.

(2) In regulation 1(2)(b), in the definition of “Direct Payment Scheme” –

(a)in paragraph (ii) for the full stop substitute “, or”;

(b)after paragraph (ii) add –

(iii)schemes for direct payment to farmers made under retained Regulation (EU) No. 1305/2013 of the European Parliament and of the Council of 17 December 2013 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD) and repealing Council Regulation (EC) No. 1698/2005(4)..

3.  In regulation 2, omit “in so far as it relates to direct payment schemes”.

Amendment of retained Commission Implementing Regulation (EU) No. 809/2014N.I.

4.—(1) Retained Commission Implementing Regulation (EU) No. 809/2014(5) with regard to the integrated administration and control system, rural development measures and cross compliance, is amended as follows.

(2) In Article 68, omit paragraph (4).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations enable the Department to amend Regulation S.R. 2022 No. 240 – The Direct Payments to Farmers (Cross-Compliance) (Amendment) Regulations (Northern Ireland) 2022 to include schemes for direct payment to farmers made under retained Regulation (EU) No. 1305/2013.

Regulation 4 amends retained Commission Regulation (EU) 809/2014 to remove the requirement to increase the number of on-the-spot-checks for any act or standard revealing significant degree of non-compliance.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
