3.—(1) The Marketing of Vegetable Plant Material Regulations (Northern Ireland) 1995(1) are amended as follows.
(2) In regulation 2(2) (interpretation)—
(a)omit the definition of “Directive 92/33/EEC”;
(b)in the definition of “Directive 93/61/EEC” for “Directive 92/33/EEC” substitute “Directive 2008/72/EC”;
(c)after the definition of “Directive 93/61/EEC”, insert—
““Directive 2008/72/EC” means Council Directive 2008/72/EC of 15th July 2008(2) on the marketing of vegetable propagating and planting material, other than seed, as amended from time to time;”;
(3) In regulation 3(1)(a), for “Directive 93/33/EEC” substitute “Directive 2008/72/EC”.
(4) In regulation 5(d)(ii), for “Directive 92/33/EEC” substitute “Directive 2008/72/EC”.

Explanatory Memorandum
