The Department of Health(1), in conjunction with the Department of Finance, in exercise of the powers conferred by Articles 55A(1)(a), 61(1) and (2), 106 and 107(6) of the Health and Personal Social Services (Northern Ireland) Order 1972(2) makes the following Regulations:
In accordance with Article 61(4) of that Order, the Department has consulted with such organisations as appear to be representative of the dental profession.
1.—(1) These Regulations may be cited as the General Dental Services (Amendment) Regulations (Northern Ireland) 2016 and shall come into operation on 10th October 2016.
(2) In these Regulations “the principal Regulations” means the Health and Personal Social Services General Dental Services Regulations (Northern Ireland) 1993(3).
2. In regulation 19 of the principal Regulations (Statement of Dental Remuneration), for the Table in paragraph (1) substitute—
“(1) Determination | (2) Subject Matter of Determination |

I | A Scale of Fees which shall prescribe the remuneration to be paid to a dentist, other than a salaried dentist, for care and treatment under a continuing care arrangement or a capitation arrangement, treatment on referral and occasional treatment and the conditions of payment of remuneration; |
II | Rates of remuneration for a salaried dentist and for the provision of emergency dental services; |
III | Seniority payments |
IV | Vocational training allowances/General Professional training allowance; |
V | Maternity, paternity and adoption leave payments; |
VI | Long term sickness payments; |
VII | Continuing professional development allowances |
VIII | Reimbursement of non-domestic rates; |
IX | Clinical audit allowances; |
X | Practice Allowance.” |
3. In Schedule 2 to the principal Regulations (terms of service for dentists), in sub-paragraph (4) of paragraph 25 (Records), omit “(other than the practice record form)”.

These Regulations amend the Health and Personal Social Services General Dental Services Regulations (Northern Ireland) 1993 which regulate the terms on which general dental services are provided under the Health and Personal Social Services (Northern Ireland) Order 1972.
Regulation 2 amends regulation 19 of the principal regulations to reflect the new numbering of determinations relating to matters set out in the Statement of Dental Remuneration following the ceasing of commitment payments to dentists.
Regulation 3 amends the dentists terms of service contained in Schedule 2 of the principal regulations to enable a dentist to keep all referred forms of records detailed in the Regulations, including the practice record form, in computerised form.
