The Department of the Environment makes the following Regulations in exercise of the powers conferred by Article 4(4) of the Environment (Northern Ireland) Order 2002(1).

In accordance with Article 4(4) of the Environment (Northern Ireland) Order 2002, the Department has consulted district councils as it considers appropriate, such bodies or persons appearing to it to be representative of the interests of industry, agriculture and business as it considers appropriate and such bodies or persons as it considers appropriate.

Citation, commencement and interpretation

1.  These Regulations may be cited as the Waste Management Licensing (Amendment No. 2) Regulations (Northern Ireland) 2014 and shall come into operation on 24^th October 2014.

Amendment of the Waste Management Licensing Regulations (Northern Ireland) 2003

2.  After regulation 11B of the Waste Management Licensing Regulations (Northern Ireland) 2003(2) insert—

“Conditions of waste management licences: calculation of recycling efficiencies of the recycling processes of waste batteries and accumulators

11C.— (1) The Department must exercise its relevant functions so as to ensure compliance with Article 3 of Regulation (EU) No 493/2012(3); and for the purposes of Article 3(4) of that Regulation the Department is the competent authority.

(2) Regulation (EU) No 493/2012 means Regulation (EU) No 493/2012 laying down, pursuant to Directive 2006/66/EC(4) of the European Parliament and of Council, detailed rules regarding the calculation of recycling efficiencies of the recycling processes of waste batteries and accumulators.”

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations implement Regulation (EU) No 493/2012 of 11 June 2012 laying down, pursuant to Directive 2006/66/EC of the European Parliament and of the Council, detailed rules regarding the calculation of recycling efficiencies of the recycling process for waste batteries and accumulators.

Regulation 2 implements Article 3 of the Commission Regulation in relation to the methods of calculation of recycling efficiency and for the purposes of Article 3(4) of the Regulation the Department is the competent authority.
