The Department of the Environment in exercise of the powers conferred by Articles 2(3) and 5(7) of the Waste and Contaminated Land (Northern Ireland) Order 1997(1), makes the following Regulations.
1.—(1) These Regulations may be cited as the Controlled Waste and Duty of Care (Amendment) Regulations (Northern Ireland) 2014 and shall come into operation on 30th May 2014.
2.—(1) The Controlled Waste and Duty of Care Regulations (Northern Ireland) 2013(2) shall be amended as follows.
(2) In the Schedule—
(a)in paragraph 1 (Interpretation of the Schedule) insert in the appropriate alphabetical order—
““bed and breakfast” means an establishment meeting the criteria set out in Schedule 3 to the Categories of Tourist Establishment (Statutory Criteria) Regulations (Northern Ireland) 1992(3);
“guest House” means an establishment meeting the criteria set out in Schedule 2 to the Categories of Tourist Establishment (Statutory Criteria) Regulations (Northern Ireland) 1992;””
(b)in paragraph 2 (Sources of household, industrial and commercial waste) in Table 1 at item 7 for “A ‘Bed and Breakfast’” substitute “A ‘Bed and Breakfast’ or a ‘Guest House’”;
(c)in paragraph 2 (Sources of household, industrial and commercial waste) in Table 1 at item 22 for “The practice of a general medical practitioner” substitute “The practice premises of a general medical practitioner”;
(d)in paragraph 3(Nature of waste and activities producing waste)
(i)in Table 2 at item 2 after “(duty to ensure roads are kept clean)” insert “where it relates to household waste as classified in Table 1”; and
(ii)in item 5 after “(duty to ensure roads are kept clean)” insert “where it relates to industrial waste as classified in Table 1”.

These Regulations amend the Controlled Waste and Duty of Care Regulations (Northern Ireland) 2013 in that they provide clarification in relation to the classification of a number of items contained in the tables to the Schedule.
