The Department of the Environment, in exercise of the powers conferred by Article 4 of the Environment (Northern Ireland) Order 2002(1), and having, in accordance with Article 4(4) of that Order, consulted district councils and such bodies or persons appearing to it to be representative of the interests of district councils as it considers appropriate, such bodies and persons appearing to it to be representative of the interests of industry, agriculture and business as it considers appropriate and such other bodies or persons as it considers appropriate, makes the following Regulations.
1.—(1) These Regulations may be cited as the Pollution Prevention and Control (Amendment) Regulations (Northern Ireland) 2009 and come into operation on 31st December 2009.
(2) In these Regulations “the Principal Regulations” means the Pollution Prevention and Control Regulations (Northern Ireland) 2003(2).
2.—(1) In paragraph (4) of regulation 10 of the Principal regulations, for sub-paragraph (b) substitute—
“(b)in the case of an installation where the use of the application site for the carrying out of that activity requires planning permission granted under the Planning (Northern Ireland) Order 1991—
(i)such planning permission is in force in relation to the use of the land, or
(ii)a certificate under Article 83A of that Order has been issued in respect of that use of the land.”

These Regulations amend the Pollution Prevention and Control Regulations (Northern Ireland) 2003 (“the PPC Regulations”).
Regulation 2 amends regulation 10(4)(b) of the PPC Regulations to include an additional provision for a Certificate of Lawful Use or Development.
