The Department of Finance and Personnel, being a Department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the energy performance of buildings and in exercise of the powers conferred by section 2(2) of the said Act, hereby makes the following Regulations.
1. These Regulations may be cited as the Energy Performance of Buildings (Certificates and Inspections) (Amendment) Regulations (Northern Ireland) 2008 and shall come into operation on 30th June 2008.
2. In these Regulations “the principal Regulations” means the Energy Performance of Buildings (Certificates and Inspections) Regulations (Northern Ireland) 2008 (3).
3.—(1) The principal Regulations are amended as follows.
(2) In regulation 11(1) (duties relating to display energy certificates and advisory reports) for “building” there shall be substituted “buildings”.
(3) In regulation 18 (changes of relevant person) for “4th January 2012” there shall be substituted “4th January 2011”.
(4) In regulation 31(2) (enforcement authorities) the reference to “16(1)” shall be deleted.
(5) In regulation 33(1) (penalty charge notices) the reference to “16(1)” shall be deleted.
(6) In regulation 40(1) (offences relating to enforcement officers) for “regulation 28” there shall be substituted “regulation 32”.

These Regulations amend the Energy Performance of Buildings (Certificates and Inspections) Regulations (Northern Ireland) 2008.
Regulations 3(2) and 3(3) make changes by way of minor corrections.
Regulation 3(4) removes an erroneous reference to regulation 16(1) (inspection reports) in regulation 31(2).
Regulation 3(5) removes an erroneous reference to regulation 16(1) (inspection reports) in regulation 33(1).
Regulation 3(6) replaces an incorrect reference to regulation 28 (disclosures to approved accreditation schemes) in regulation 40(1) (offences relating to enforcement officers) with the correct reference to regulation 32 (power to require production of documents).
