The Lord Chancellor, after consultation with the Lord Chief Justice, makes the following Order in exercise of the powers conferred by Article 34 of the Family Homes and Domestic Violence (Northern Ireland) Order 1998(1).
1. This Order may be cited as the Family Homes and Domestic Violence (Allocation of Proceedings) (Amendment) Order (Northern Ireland) 2007 and shall come into operation on 17th December 2007.
2. In Article 2 (Classes of county court)—
(a)at the end of paragraph (a) omit “and”;
(b)in paragraph (b) for “the 1996 Order.” substitute “the 1996 Order; and”; and
(c)after paragraph (b) insert—
“(c)civil partnership proceedings county courts, being those county courts designated for the time being as civil partnership proceedings county courts by an order made under section 188(4) of the Civil Partnership Act 2004.”.
3. In Article 4 (Commencement of proceedings), in paragraph (3) after “divorce county court” insert “, civil partnership proceedings county court”.

This Order amends the Family Homes and Domestic Violence (Allocation of Proceedings) Order (Northern Ireland) 1999 [S.R. 1999 No. 61] in consequence of the Civil Partnership Act 2004, in particular, to add civil partnership proceedings county courts to the classes of county court specified to hear proceedings under the Family Homes and Domestic Violence (Northern Ireland) Order 1998.
S.I. 1998/1071 (N.I. 6) to which the most recent relevant amendment was made by the Constitutional Reform Act 2005 (2005 c.4).
