The Department of the Environment makes the following Regulations in exercise of the powers conferred by Articles 61(1), 66(1) and 218(1) of the Road Traffic (Northern Ireland) Order 1981(1).
1. These Regulations may be cited as the Public Service Vehicles (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 19th July 2006.
2. In paragraph (6) of regulation 6 of the Public Service Vehicles Regulations (Northern Ireland) 1985(2)(inspection of vehicle and grant of licence), after the words “Conditions of Fitness Regulations” there shall be inserted “or in the case of a bus, the Conditions of Fitness Regulations or Directive 2001/85/EC of the European Parliament and of the Council of 20th November 2001”(3).

These Regulations amend regulation 6 of the Public Service Vehicles Regulations (Northern Ireland) 1985 to include Directive 2001/85/EC (O.J. No. L42, 13.2.2002, p. 1) in the list of statutory requirements. This will allow buses to meet the requirements of the Directive as an alternative to the requirements of the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995.
