8. In Article 7—
(a)there shall be substituted for paragraph (1) the following paragraph—
“(1) A gift (including a gift made before the commencement of the 1998 Order) is caught by this Order if—
(a)it was made by the defendant at any time after the conduct to which the external confiscation order relates; and
(b)the court considers it appropriate in all the circumstances to take the gift into account.”;
(b)paragraph (2) shall be omitted.
