STATUTORY MATERNITY PAY

The Department of Health and Social Services for Northern Ireland, in exercise of the powers conferred on it by sections 163(1)(c) and 171(1) to (3) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1) and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Statutory Maternity Pay (Compensation of Employers) (Amendment) Regulations (Northern Ireland) 1998 and shall come into operation on 6th April 1998.

Amendment of the Statutory Maternity Pay (Compensation of Employers) and Miscellaneous Amendment Regulations

2.  In regulation 3 of the Statutory Maternity Pay (Compensation of Employers) and Miscellaneous Amendment Regulations (Northern Ireland) 1994(2) (amount of additional payment to which a small employer shall be entitled)—

(a)for “6th April 1997” there shall be substituted “6th April 1998”;

(b)for “6·5 per cent.” there shall be substituted “7 per cent.”.

Revocation

3.  The Statutory Maternity Pay (Compensation of Employers) (Amendment) Regulations (Northern Ireland) 1997(3) are hereby revoked.

Explanatory Note

(This note is not part of the Regulations.)

These Regulations further amend the Statutory Maternity Pay (Compensation of Employers) and Miscellaneous Amendment Regulations (Northern Ireland) 1994 (“the principal Regulations”).

The principal Regulations enable an employer to recover payments of statutory maternity pay and, if he is a small employer, an additional amount in respect of such pay. Regulation 2 of these Regulations increases the additional amount from 6·5 per cent. to 7 per cent. of the payment of statutory maternity pay. The increase takes effect from 6th April 1998.

Regulation 3 makes a consequential revocation.

These Regulations are made under section 163 of the Social Security Contributions and Benefits (Northern Ireland) Act 1992 and accordingly, by virtue of section 149(3) of, and paragraph 8 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
