23.—(1) Paragraph 11 is amended as follows.

(2) For sub-paragraph (2), substitute—

(2) In section 371(2)(1)

(a)at the end of paragraph (b), insert “or”;

(b)for paragraphs (c) and (d) substitute—

(c)transferred EU anti-trust commitments or transferred EU anti-trust directions (as defined in section 40ZA of that Act),..

(3) In sub-paragraph (5), for “exit day” in both places, substitute “IP completion day”.

(4) In sub-paragraph (6), in the text inserted as paragraph 6(7A) of Schedule 11 to the Communications Act 2003(2), for “exit day”, in each place it occurs, substitute “IP completion day”.

(5) In sub-paragraph (7), in the text inserted as paragraph 6A of Schedule 11 to the Communications Act 2003, for “exit day”, in each place it occurs, substitute “IP completion day”.

Section 371(2) was substituted by S.I. 2004/1261, and subsequently amended by paragraphs 42 and 46 of Schedule 15 to the Enterprise and Regulatory Reform Act 2013 and by S.I. 2012/1809 and S.I. 2014/892.
