2.—(1) The functions of the Secretary of State under—
(a)the European Parliament (Pay and Pensions) Act 1979(1), and
(b)any order made under that Act,
are hereby transferred to the Lord President of the Council.
(2) Subject to paragraphs (4) and (5), the words “Lord President of the Council” shall be substituted for the words “Secretary of State” wherever they occur in the provisions mentioned in paragraph (1).
(3) In section 6 of the European Parliament (Pay and Pensions) Act 1979, the words “At any time after he has made an order under section 4” are hereby repealed.
(4) Paragraph (2) shall not apply to article 25(6) of the European Parliamentary (United Kingdom Representatives) Pensions (Consolidation and Amendment) Order 1994(2).
(5) Paragraph (2) shall not apply to article 5(2) of the European Parliamentary (United Kingdom Representatives) Pensions (Additional Voluntary Contributions Scheme) (No. 2) Order 1995(3); but in article 5(2) for “if the Secretary of State has appointed more than one financial institution” there shall be substituted “if more than one financial institution has been appointed”.
