THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1698/2005 of 20 September 2005 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD)(1), and in particular Article 69(4) thereof,
Whereas:
(1) Germany and Sweden have decided, in accordance with Article 136 of Council Regulation (EC) No 73/2009 of 19 January 2009 establishing common rules for direct support schemes for farmers under the common agricultural policy and establishing certain support schemes for farmers, amending Regulations (EC) No 1290/2005, (EC) No 247/2006, (EC) No 378/2007 and repealing Regulation (EC) No 1782/2003(2) to make an amount calculated in accordance with Article 69(7) of the same Regulation and fixed in Annex III of Commission Regulation (EC) No 639/2009(3) available from 2011 for rural development programming and financed under the European Agricultural Fund for Rural Development (EAFRD).
(2) Commission Decision 2008/788/EC of 3 October 2008 fixing the net amounts resulting from the application of voluntary modulation in Portugal for the calendar years 2009 to 2012(4) has been repealed and replaced by Commission Decision 2009/780/EC(5) in order to take into account the decision taken by Portugal not to apply voluntary modulation for calendar year 2009.
(3) Therefore, Commission Decision 2009/379/EC of 11 May 2009 setting the amounts which, pursuant to Council Regulations (EC) No 1782/2003, (EC) No 378/2007, (EC) No 479/2008 and (EC) No 73/2009 are made available to the EAFRD and the amounts available for EAGF expenditure(6) has been amended by Commission Decision 2009/781/EC(7) to take account of those new amounts transferred to and from EAFRD.
(4) Following the adoption of Decision 2009/780/EC and Decision 2009/781/EC the amounts made available to EAFRD should be adapted and added to the annual breakdowns of Community support for rural development.
(5) Commission Decision 2006/636/EC(8) should therefore be amended accordingly,
