2004/279/EC: Commission Decision of 19 March 2004 concerning guidance for implementation of Directive 2002/3/EC of the European Parliament and of the Council relating to ozone in ambient air (Text with EEA relevance) (notified under document number C(2004) 764)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Directive 2002/3/EC of the European Parliament and of the Council of 12 February 2002 relating to ozone in ambient air(1), and in particular Article 12(1) thereof,
Whereas:

Directive 2002/3/EC establishes long-term objectives, target values, an alert threshold and an information threshold for concentrations of ozone in ambient air.
(2)
Article 7 of Directive 2002/3/EC requires Member States under particular conditions to draw up short-term action plans, where there is a risk of exceedances of the alert threshold. The guidance developed by the Commission in this respect should in accordance with Article 7(3) provide Member States with examples of measures, the effectiveness of which has been assessed.

In accordance with Article 9(3) of Directive 2002/3/EC, the Commission should provide Member States with guidelines for an appropriate strategy to measure ozone precursor substances in ambient air, as part of the guidance to be developed under Article 12 of that Directive.

In drawing up the guidance and guidelines in question the Commission has called upon expertise in the Member States and in the European Environment Agency.

The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 12(2) of Council Directive 96/62/EC of 27 September 1996 on ambient air quality assessment and management(2),
