The Local Health Boards (Constitution, Membership and Procedures) (Wales) Regulations 2009

Explanatory Note

(This note is not part of the Regulations)

1.  These Regulations, which apply in relation to Wales, revoke the Local Health Board (Constitution, Membership and Procedures) (Wales) Regulations 2003 (S.I. 2003/149 (W.19))(“ the 2003 Regulations”) and the Local Health Boards (Constitution, Membership and Procedures) (Wales) (Amendment) Regulations 2007 (S.I. 2007/953 (W.84))(“the 2007 Regulations). They make provisions for the constitution and membership of the Local Health Boards including their procedures and administrative arrangements. E+W

2.  Part 2 of these Regulations make provisions— E+W

(a) for the composition and membership of the Boards (regulation 3);

(b) for the appointment of their members (regulation 4);

(c) for eligibility requirements for their members (regulation 5 and Schedule 2);

(d) in relation to tenure of office, termination of appointment and suspension of their members (regulations 6 to 12).

3.  Part 3 contains various provisions in relation to the proceedings of the Board including the powers of the vice-chair, procedures for meetings and provisions about when a member is prohibited from voting. E+W

4.  Part 4 sets out transitional arrangements for Powys Teaching Local Health Board and provides for new members to be appointed and for existing members to cease to be members. E+W

5.  Part 5 contains transitional arrangements for the new Local Health Boards to replace the existing Local Health Boards and provisions to revoke the 2003 Regulations and the 2007 Regulations. E+W
