The Secretary of State, in exercise of the powers conferred by section 32(1) and (2) of the Broadcasting Act 1996(1), makes the following Order:
1. This order may be cited as the Multiplex Licence (Broadcasting of Programmes in Gaelic) (Revocation) Order 2011 and comes into force on 23rd May 2011.
2. The following Orders are revoked—
(a)The Multiplex Licence (Broadcasting of Programmes in Gaelic) Order 1996(2); and
(b)The Multiplex Licence (Broadcasting of Programmes in Gaelic) Order 2008(3).

This Order revokes the Multiplex Licence (Broadcasting of Programmes in Gaelic) Order 1996 and the 2008 Order, which amended it.
These Orders required OFCOM to secure a condition on certain multiplex licences, when the holders broadcast programmes for reception wholly or mainly in Scotland, that Gaelic programming be carried for at least 30 minutes per day between the hours of 6pm and 10.30pm.
An agreement has been reached between the BBC and MG ALBA for the carriage of BBC ALBA on Freeview. The Secretary of State now considers it unnecessary to require the provision of Gaelic programming.
A full impact assessment has not been produced for this instrument as no impact on business, the public or voluntary sector is envisaged.
