The Secretary of State, in exercise of the powers conferred on him by sections 8 and 28 of the Employment Act 1989(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Sex Discrimination Act 1975(2)(Exemption of Special Treatment for Lone Parents) Order 1991 and shall come into force on 14th January 1992.

Interpretation

2.  In this Order–

“the Council” means the National Council for One Parent Families;

“the Return to Work Programme” means arrangements known by that name made under section 2 of the Employment and Training Act 1973(3) for the provision by or on behalf of the Council of training and other assistance to persons wishing to obtain employment.

Exemption of special treatment

3.  With respect to the Return to Work Programme, section 8 of the Employment Act 1989 shall apply to any special treatment afforded to or in respect of lone parents–

(a) by the fixing of any special condition for participation in the Programme, or

(b) by the making of any payment in respect of the care of a child of a lone parent while that lone parent is participating in the Programme.

Explanatory Note

(This note is not part of the Order)

This Order provides that section 8 of the Employment Act 1989 shall apply to certain special treatment for lone parents in the “Return to Work Programme” under which the National Council for One Parent Families is to provide training and other assistance to persons who wish to return to work. That section is to apply to special treatment which consists either of fixing special conditions for participation in the Programme or of making payments in respect of the care of a child of a lone parent while the lone parent is participating in the Programme.

Where section 8 of the 1989 Act applies to special treatment afforded to or in respect of lone parents then, by virtue of section 8(2), neither the treatment so afforded nor any act done in the implementation of such treatment is to be regarded for the purposes of the Sex Discrimination Act 1975 as giving rise to any discrimination falling within section 3 of the 1975 Act (which deals with discrimination against married persons for the purposes of the provisions in Part II of the 1975 Act).
