Whereas Her Majesty in pursuance of the Regency Acts 1937 to 1953,was pleased, by Letters Patent dated the 3rd day of May 1991 to delegateto the six Counsellors of State therein named or any two or more of themfull power and authority during the period of Her Majesty’s absence fromthe United Kingdom to summon and hold on Her Majesty’s behalf Her PrivyCouncil and to signify thereat Her Majesty’s approval for anything forwhich Her Majesty’s approval in Council is required:

And whereas a draft of this Order has been laid before Parliamentand has been approved by a resolution of each House of Parliament:

Now, therefore, His Royal Highness The Prince Andrew, Duke of York,and His Royal Highness The Prince Edward, being authorised thereto bythe said Letters Patent, and in pursuance of the powers conferred on HerMajesty by section 2(2) of the European Communities Act 1972(1), are pleased, by and with the advice of Her Majesty'sPrivy Council, on Her Majesty’s behalf to order, and it is herebyordered, as follows:—

Citation and commencement

1.  This Order may be cited as the Veterinary Surgeons Qualifications(EEC Recognition) (German Democratic Republic Qualifications) Order 1991and shall come into force on 1st July 1991.

Amendment to provision for recognition of qualifications inveterinary medicine

2.—(1) In section 5A of the Veterinary Surgeons Act 1966(2) (right of holders of recognised European qualificationsto be registered) after subsection (3) there shall be inserted thefollowing subsection—

(3A) A person holding a qualification as to training received in theterritory of the former German Democratic Republic but which does notsatisfy the requirements laid down by the Training Directive shall notbe entitled to be registered by virtue of that qualificationunless—

(a)that qualification indicates that such training commenced beforeGerman unification,

(b)that qualification indicates that the holder isentitled to practise as a veterinary surgeon throughout the territory ofGermany to the same extent as the holder of the German State examinationcertificate in veterinary medicine, and

(c)he produces to the registrar a certificate of the competent Germanauthority that he has lawfully practised veterinary surgery in Germanyfor at least three consecutive years during the five years preceding thedate of issue of the certificate..

(2) In Schedule 1A to the Veterinary Surgeons Act 1966 (recognisedEuropean qualifications in veterinary surgery) under the sub-heading“Germany”, paragraph 2 (relating to diplomas issued by the competentauthorities in the German Democratic Republic) shall be deleted and thefigure“1” shall be omitted from the beginning of the remaining paragraph.

Explanatory Note

(This note is not part of the Order)

This Order, which is made under the European Communities Act 1972,amends the Veterinary Surgeons Act 1966 for the purpose of implementingCouncil Directive 90/658/EEC(3)which amends Council Directive 78/1026/EEC(4) relating to the right of establishment of veterinarysurgeons and their freedom to provide veterinary services.

Following German unification, holders of German Democratic Republicveterinary qualifications will be able to practise in the United Kingdomprovided they can meet specified conditions.
