Section 13: Review of Act

38.The Scottish Ministers must, for each review period, review the operation and effectiveness of the Act and prepare a report of the review—these functions can be delegated to a person that the Scottish Ministers consider appropriate.

39.When undertaking the review, the Scottish Ministers (or the person to whom the review function is delegated) must consult Police Scotland, the Crown Office and Procurator Fiscal Service, operators of protected premises or their representatives and any other person they consider appropriate. In addition to this, the Scottish Ministers must also publish the report and lay it before the Scottish Parliament.

40.The first review period is 2 years beginning on the day on which section 2 comes into force. After that, the review period is each subsequent 3 year period.
