Section 5 – Hierarchy of developments for purposes of development management etc.

62.This section inserts new section 26A into the 1997 Act. Subsection (1) sets out the three categories to which all developments will be allocated. Subsections (2) and (4) give the Scottish Ministers powers to make regulations to describe the classes of major and local development. National developments are those designated as such in the National Planning Framework. Subsection (3) enables the Scottish Ministers to direct that a particular local development is assigned to the class of major developments Subsection (5) requires that regulations under subsection (2) are to be subject to affirmative procedure.
