The Welsh Ministers make the following Order in exercise of the powers conferred by sections 1 and 8(1) of the Animal Health Act 1981(1).

Title and coming into force

1.—(1 ) The title of this Order is the Bovine Viral Diarrhoea (Wales) (Amendment) Order 2026.

(2) This Order comes into force on 1 July 2026.

Amendment of the Bovine Viral Diarrhoea (Wales) Order 2024

2.—(1) The Bovine Viral Diarrhoea (Wales) Order 2024(2) is amended as follows.

(2) In article 40(2) (Pre-movement testing), before sub-paragraph (a) insert—

(za)for animals that (at the point a sample is taken) are aged 20 days or less, take an ear tag sample of tissue in accordance with article 13, or.

(3) In article 41(2) (Post-movement testing of animals without a known individual BVD status from herds outside of Wales), before sub-paragraph (a) insert—

(za)take an ear tag sample of tissue in accordance with article 13, or.

Explanatory Note

(This note is not part of the Order)

This Order amends the Bovine Viral Diarrhoea (Wales) Order 2024 (S.I. 2024/753 (W. 105)) (“the 2024 Order”).

Article 2(2) amends article 40(2) of the 2024 Order allowing keepers themselves to take ear tag samples of tissue (in accordance with article 13 of the 2024 Order) from calves that are aged 20 days or less at the point the sample is taken, for the purpose of pre-movement testing.

Article 2(3) amends article 41(2) of the 2024 Order allowing keepers themselves to take ear tag samples of tissue (in accordance with article 13 of the 2024 Order) from animals for the purpose of post-movement testing.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.

Functions of “the Ministers” under the Animal Health Act 1981 (as defined in section 86(1) of that Act) are exercisable by the Welsh Ministers (in relation to Wales) by virtue of the National Assembly for Wales (Transfer of Functions) Orders 1999 and 2004 (S.I. 1999/672 and S.I. 2004/3044) and section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32).
