Coming into force in accordance with regulation 1(2) and (3)

The Welsh Ministers make the following Regulations in exercise of the powers conferred on them by section 71(1)(a) of the Elections and Elected Bodies (Wales) Act 2024(1).

Title and coming into force

1.—(1) The title of these Regulations is the Elections and Elected Bodies (Wales) Act 2024 (Consequential Amendments) Regulations 2025.

(2) Regulations 1, 2, 3 and 4 come into force on 1 April 2025.

(3) Regulations 5 and 6 come into force on 1 April 2026.

The Freedom of Information (Additional Public Authorities) Order 2010

2.  In Part 1 (entries inserted with effect from 1 October 2010) of the Schedule to the Freedom of Information (Additional Public Authorities) Order 2010(2), omit “The Independent Remuneration Panel for Wales”.

The Elections (Wales) (Amendment) (EU Exit) Regulations 2019

3.  In the Elections (Wales) (Amendment) (EU Exit) Regulations 2019(3), omit regulation 2 (amendment to the Local Government (Wales) Measure 2011) and the heading before it.

The Corporate Joint Committees (General) (No. 2) (Wales) Regulations 2021

4.  In the Corporate Joint Committees (General) (No. 2) (Wales) Regulations 2021(4), omit regulation 4 (the Independent Remuneration Panel for Wales) and the heading before it.

The Education (Admission Appeals Arrangements) (Wales) Regulations 2005

5.—(1) The Education (Admission Appeals Arrangements) (Wales) Regulations 2005(5) are amended as follows.

(2) In regulation 2(1) (interpretation)—

(a)omit ““the 2011 Measure” (“Mesur 2011”) means the Local Government (Wales) Measure 2011;”;

(b)in the appropriate places in alphabetical order insert—

the 2013 Act” (“Deddf 2013”) means the Democracy and Boundary Commission Cymru etc. Act 2013;;

the Commission” (“y Comisiwn”) means the Democracy and Boundary Commission Cymru;.

(3) In regulation 7(3) (payment of allowances), for “Independent Remuneration Panel for Wales issued under Part 8 of the 2011 Measure (members: payments and pensions)” substitute “Commission issued under Part 5A of the 2013 Act (functions relating to payments and pensions)(6)”.

The Local Authorities (Model Code of Conduct) (Wales) Order 2008

6.  In paragraph 12(2)(b)(iv) (prejudicial interests) of the model code in the Schedule to the Local Authorities (Model Code of Conduct) (Wales) Order 2008(7), after “Part 8 of the Local Government (Wales) Measure 2011,” insert “Part 5A of the Democracy and Boundary Commission Cymru etc. Act 2013,”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made under section 71 of the Elections and Elected Bodies (Wales) Act 2024 (“the 2024 Act”) which enables the Welsh Ministers to make provision for the purposes of, in consequence of, or for giving full effect to, any provision of the 2024 Act.

The 2024 Act abolishes the Independent Remuneration Panel for Wales (“the Panel”) and provides for functions previously undertaken by the Panel to be undertaken by the Democracy and Boundary Commission Cymru (“the Commission”).

These Regulations make consequential amendments to secondary legislation as a result of section 56 of the 2024 Act which abolishes the Panel, and section 57 of the 2024 Act which imposes functions previously undertaken by the Panel on the Commission.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.

Part 5A was inserted into the Democracy and Boundary Commission Cymru etc. Act 2013 (anaw 4) by section 57 of the Elections and Elected Bodies (Wales) Act 2024 (asc 5). Section 57 of the 2024 Act was brought into force on 1 April 2025 by article 3 of S.I. 2024/1337 (W. 226).
