The Welsh Ministers, in exercise of the powers conferred on them by section 48 of the Social Partnership and Public Procurement (Wales) Act 2023(1), make the following Order.
1.—(1) The title of this Order is the Social Partnership and Public Procurement (Wales) Act 2023 (Commencement No. 4) Order 2025.
(2) In this Order, “the Act” means the Social Partnership and Public Procurement (Wales) Act 2023.
2. The following provisions of the Act come into force on 25 March 2026—
(a)section 22(2) (contracting authorities);
(b)section 24(1) to (7) (socially responsible procurement duty);
(c)section 25(1) (socially responsible procurement duty: major construction contracts);
(d)section 26(1) (socially responsible procurement duty: outsourcing services contracts);
(e)section 28 (social public works clauses in subcontracts);
(f)section 29 (social public works clauses: notifying the Welsh Ministers);
(g)section 30 (social public works clauses: Welsh Ministers’ response);
(h)section 31 (social public works clauses: Welsh Ministers’ contracts);
(i)section 34 (social public workforce clauses in subcontracts);
(j)section 35 (social public workforce clauses: notifying the Welsh Ministers);
(k)section 36 (social public workforce clauses: Welsh Ministers’ response);
(l)section 37 (social public workforce clauses: Welsh Ministers’ contracts);
(m)section 38 (procurement strategy);
(n)section 40 (contracts register), for all remaining purposes;
(o)section 41 (procurement investigations);
(p)Schedule 2 (socially responsible procurement objectives).
3. The following provisions of the Act come into force on 1 April 2026—
(a)section 39 (annual socially responsible procurement reports), for all remaining purposes;
(b)section 42 (Welsh Ministers’ annual report on public procurement).

This is the fourth commencement order made by the Welsh Ministers under the Social Partnership and Public Procurement (Wales) Act 2023 (asc 1) (“the Act”).
This Order brings into force the remaining provisions of the Act for all purposes.
The provisions listed in article 2 are brought into force on 25 March 2026 and the provisions listed in article 3 are brought into force on 1 April 2026.
