NODYN ESBONIADOL

Mae Deddf yr Amgylchedd Hanesyddol (Cymru) 2023 (“Deddf 2023”) yn cydgrynhoi’r brif ddeddfwriaeth ar gyfer cadwraeth yr amgylchedd hanesyddol yng Nghymru. Mae Deddf 2023 yn ffurfio rhan o god o gyfraith sy’n ymwneud ag amgylchedd hanesyddol Cymru.

Y prif Ddeddfau a ddygwyd ynghyd yn yr ymarfer cydgrynhoi hwnnw yw Deddf Adeiladau Hanesyddol a Henebion Hynafol 1953 (p. 49), Deddf Henebion Hynafol ac Ardaloedd Archaeolegol 1979 (p. 46), Deddf Cynllunio (Adeiladau Rhestredig ac Ardaloedd Cadwraeth) 1990 (p. 9) a Deddf yr Amgylchedd Hanesyddol (Cymru) 2016 (dccc 4). Gwnaeth Deddf 2023 rai newidiadau i’r derminoleg a ddefnyddir yn y Deddfau hynny.

Mae Deddf 2023 hefyd yn ailddatgan darpariaethau a geir ar hyn o bryd mewn Deddfau eraill sy’n berthnasol i’r amgylchedd hanesyddol. Mae’r rhain yn cynnwys Deddf Llywodraeth Leol 1972 (p. 70), Deddf Cynllunio Gwlad a Thref 1990 (p. 8) a Deddf Cynllunio a Phrynu Gorfodol 2004 (p. 5). Mae Deddf 2023 hefyd yn ymgorffori rhai darpariaethau o is-ddeddfwriaeth.

Mae’r Rheoliadau hyn yn gwneud diwygiadau sy’n ganlyniadol ar Ddeddf 2023 i is-ddeddfwriaeth.

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
