3. Yn lle erthygl 8 o Orchymyn Deddf Anghenion Dysgu Ychwanegol a’r Tribiwnlys Addysg (Cymru) 2018 (Cychwyn Rhif 4 a Darpariaethau Trosiannol a Darpariaethau Arbed) 2021(1) rhodder—
“Hawl i ofyn am gael trosglwyddo i’r gyfraith newydd
8.—(1) Caiff plentyn sydd ag anghenion addysgol arbennig a nodwyd ar 1 Medi 2021, neu riant y plentyn hwnnw, wneud cais i’r person priodol i’r gyfraith newydd fod yn gymwys i’r plentyn hwnnw.
(2) Mae’r gyfraith newydd yn gymwys mewn perthynas â’r plentyn ar y dyddiad y daw’r cais i law.
(3) Mae’r hen gyfraith yn peidio â bod yn gymwys mewn perthynas â’r plentyn ar y dyddiad hwnnw.
(4) Yn yr erthygl hon, ystyr “person priodol” yw—
(a)yr awdurdod lleol yng Nghymru sy’n gyfrifol am y plentyn,
(b)pan na fo awdurdod lleol yng Nghymru yn gyfrifol am y plentyn, awdurdod lleol yng Nghymru y mae’r ysgol a gynhelir neu’r uned cyfeirio disgyblion y mae’r plentyn yn ddisgybl cofrestredig ynddi yn ei ardal.”.
