Materion iʼw hystyried wrth ddyroddi cyfarwyddydau mewn cysylltiad ag oriau agor
14.—(1) Pan fo Bwrdd Iechyd Lleol yn dyroddi cyfarwyddyd syʼn pennu unrhyw ddiwrnodau neu amseroedd o dan yr Atodlen hon, rhaid iddo, wrth wneud hynny, geisio sicrhau bod yr oriau y mae mangre ar agor ar gyfer darparu gwasanaethau fferyllol yn rhai syʼn sicrhau y darperir y gwasanaethau fferyllol ar y diwrnodau hynny ac ar yr amseroedd hynny syʼn angenrheidiol er mwyn diwallu anghenion pobl yn y gymdogaeth, neu ddefnyddwyr tebygol eraill y fangre, am wasanaethau fferyllol.
(2) Wrth ystyried y materion a grybwyllir yn is-baragraff (1)—
(a)rhaid iʼr Bwrdd Iechyd Lleol drin unrhyw wasanaethau fferyllol lleol a ddarperir yn y gymdogaeth honno ar y diwrnodau a’r amseroedd o dan sylw fel pe baent yn wasanaethau fferyllol a ddarperid felly, a
(b)caiff y Bwrdd Iechyd Lleol roi sylw i unrhyw wasanaethau fferyllol a ddarperir yn y gymdogaeth honno o dan amgylchiadau pan na foʼr person syʼn darparuʼr gwasanaethau fferyllol o dan rwymedigaeth i ddarparuʼr gwasanaethau hynny.
(3) Ni chaiff y Bwrdd Iechyd Lleol gyfarwyddo y caiff contractwr cyfarpar GIG ddarparu gwasanaethau fferyllol yn y fangre am lai na 30 o oriau yn ystod unrhyw wythnos, oni bai ei fod wedi ei fodloni bod y trefniadau ar gyfer cyflenwi cyfarpar yn y gymdogaeth yn debygol o fod yn ddigonol i ddiwalluʼr angen am wasanaethau oʼr fath ar yr amseroedd pan nad yw’r contractwr cyfarpar GIG yn darparu gwasanaethau fferyllol.
(4) Ni chaiff Bwrdd Iechyd Lleol gyfarwyddo bod rhaid i gontractwr cyfarpar GIG ddarparu gwasanaethau fferyllol yn y fangre am fwy na 30 o oriau yn ystod unrhyw wythnos, oni bai bod Bwrdd Iechyd Lleol wedi ei fodloni y bydd y contractwr cyfarpar GIG yn cael tâl rhesymol mewn cysylltiad âʼr oriau ychwanegol y maeʼn ofynnol iddo ddarparu gwasanaethau fferyllol (ac mae unrhyw dâl ychwanegol syʼn daladwy o dan y Tariff Cyffuriau mewn cysylltiad âʼr oriau hynny yn “dâl rhesymol” at y dibenion hyn).
